GACC Announcement 90, 2010 on ECFA Early-Harvest Program for Goods Trade

Announcement No. 90, 2010 of the General Administration of Customs of the P. R. China (GACC)
1. Conventional tariffs may apply as of January 1, 2011 to imports of 557 HS Codes-covered commodities originating in Taiwan region, which are released by GACC Announcement No. 85, 2010).
Any goods importation applicable to conventional tariffs shall be accompanied by Certificates of Origin signed and issued on or after January 1, 2011 and shall start to be transported on or after January 1, 2011.
2. When declaring the import of conventional tariff-covered goods originating in Taiwan region, the import consignee or its agent shall fill in the Customs Declaration Form for Import Goods of the people's Republic of China according to China Customs declaration regulations, and shall fill in "14" for the "Preferential Trade Agreement Code" item.
3. Upon the arrival of goods on the Chinese Mainland from any third party except the Mainland and Taiwan, the importer shall submit the certifying documents issued by the third party customs authority in addition to compliant documents/certificates required by the Regulatory Measures of the Customs of the People's Republic of China on Place of Origin of Import & Export Goods under the Cross-Straits Economic Cooperation Framework Agreement (GACC Decree No. 200).
Where such certifying documents are not presented or not adequate to prove the conformity of goods concerned to the direct consignment rules stipulated in the GACC Decree No. 200, the goods concerned may not take advantage of the preferential tariff rates covered by the ECFA.
Where the goods are transported via Hong Kong or Macao regions, the import consignee, agent or carrier shall in advance inform Hong Kong or Macao customs authorities of the transportation and their request for issuance of relevant certifying documents, and shall ensure intactness of the locking devices used for the goods.
4. With respect to export goods under the ECFA, the export consignor or its agent shall fill in the Customs Declaration Form for Export Goods of the people's Republic of China according to China Customs declaration regulations, and fill the Number column "<>" of any attached documents/certificates with the Preferential Trade Agreement Code X+":"+ relevant commodity number, together with submission to the Customs of the Certificate-of-Origin copies or relevant electronic data.
