GACC Announcement 71, 2011 for AD on U.S. & EU Optical Fibers

Announcement No. 71, 2011 of the General Administration of Customs of China (GACC)

On April 22, 2011, China started to levy a five-year anti-dumping (AD) duty on importing Dispersion Unshifted Single-Mode Optical Fibers (HS Code: 90011000) originating in the U.S. and the EU, for which the Announcement No. 24, 2011 is jointly issued by the GACC and China's General Administration of Quality Supervision, Inspection & Quarantine (AQSIQ).

According to the Announcement No. 24, 2011:

Upon their import declarations, the importers of other optical fibers uncovered by the anti-dumping (HS Code: 9001100009), also originating in the U.S. and the EU, shall submit to China Customs the After-Inspection Certificate for Entry Goods issued by entry-exit inspection and quarantine institutions.

Upon the After-Inspection Certificate for Entry Goods, the customs may conduct inspection and release of such goods, but shall levy certain cash deposit as per anti-dumping duty rates applicable to different manufacturers, which are listed in that Announcement.

The customs shall determine whether the goods are subject to the anti-dumping measures based on inspection certificates issued by entry-exit inspection and quarantine institutions, which are presented by the importers.

With respect to those really uncovered by the anti-dumping, the cash deposit aforesaid shall be returned to the importers.

However, pursuant to China's Regulations on Guarantee of Customs Affairs, the importers of such uncovered optical fibers (HS Code: 9001100009) may also submit to the customs applicable Letters of Guarantee on Tax Payment issued by China's banks or non-bank financial institutions, instead of the cash deposit aforesaid.
