AQSIQ Announcement No.139, 2013 on Pre-Shipment Inspection of Exports to Sudan

To facilitate China-Sudan trade development, the AQSIQ of China and the SSMO of the Republic of the Sudan jointly signed a Memorandum Of Understanding (MOU) on April 16, 2013, which requires that the Chinese authorities should conduct pre-shipment inspections over the industrial products exporting from China to Sudan.

Relevant matters as follows:

1. As of January 1, 2014, the SSMO of Sudan shall conduct inspection and release for the industrial products from China on the strength of the pre-shipment inspection certificates issued by China Inspection & Quarantine agencies.

2. As of November 1, 2013, local inspection-quarantine agencies in China shall start to conduct pre-shipment inspections over the industrial products exporting to Sudan, and the foreign trade operators may start to apply for the pre-shipment inspections to the local agencies.

3. The industrial products to export to Sudan refer to the products listed in the Chapters 25-29 and Chapters 31-97 under the International Convention on Harmonized Commodity Description and Coding System (HS Code).

4. The pre-shipment inspection herein shall include the inspections of product quality, quantity, safety, sanitation, environmental protection items, and the monitoring of loading or packing.

5. As per the China-Sudan MOU aforesaid, the compliance of the exported products shall be determined in sequence as per Sudanese SSMO’s standards, trade contract-listed standards, China national standards, or international standards.

6. After their inspections, local inspection-quarantine agencies shall timely issue pre-shipment inspection certificates to the applicants for relevant traders to make import declarations to the Sudanese authorities.

7. In the case of evasion from the pre-shipment inspection; counterfeit of the inspection certificates; export of counterfeit or substandard products; falsification of product names, HS Codes, and safety indicators; or change of goods after their inspections, the inspection-quarantine agencies may impose penalty on the wrongdoers involved as per China law.

8. The inspection-quarantine agencies will not charge for the pre-shipment inspection. Regarding the products listed in China Catalog of Entry-Exit Goods Subjected to Entry-Exit Inspection & Quarantine Agencies, the agencies will not charge for the inspection by the end of December 31, 2013 as per China Ministry of Finance notice of CaiZong [2013] No. 85.

9. From October 8, 2013, foreign trade operators can consult local inspection-quarantine agencies for relevant information.
