Announcement of the General Administration of Customs of China, No. 31, 2010: China Takes Anti-Dumping Duty on Imported Phthalic Anhydride Originating in Korea, Japan and India

In accordance with the provisions in the Regulations of the People's Republic of China on Anti-Dumping, the Customs Tariff Commission of the State Council of China decided to continue imposing the anti-dumping duty as of August 31, 2009 on the imported phthalic anhydride originating in Korea, in Japan and in India. Thereinto, the anti-dumping duty rate applicable to DC Chemical Co., Ltd. shall be 4% (Details as per the Announcement of the General Administration of Customs of China, No. 52, 2003). Currently, based on the application of the enterprises involved in the case, investigated by the Ministry of Commerce of China, OCI Company Ltd. shall take over the anti-dumping duty rate and relevant rights and obligations of DC Chemical Co., Ltd. in the anti-dumping case on phthalic anhydride. Relevant issues are hereby announced as follows:

1. As of May 19, 2010, the China Customs shall impose the anti-dumping duty of 4% on the imported phthalic anhydride applied under the name of OCI Company Ltd. as the original manufacturer; where the phthalic anhydride are applied and imported under the name of DC Chemical Co., Ltd., the China Customs shall impose the anti-dumping duty of 13% according to the duty rate for "other Korean enterprises".

2. Other issues concerning the taxation of anti-dumping duty on the imported phthalic anhydride originating in Korea, in Japan and in India shall still be implemented in accordance with the stipulations in the Announcement of the General Administration of Customs of China, No. 52, 2003 and No. 55, 2009.
