China's MOFCOM Preliminary Anti-Subsidy Ruling on EU Potato Starch

On May 16, 2011, China's Ministry of Commerce (MOFCOM) released its Announcement No.19, 2011 on its preliminary ruling of anti-subsidy investigation on potato starch originating in the EU.

Therein, ad valorem subsidy rate of French Roquette was 7.70%, that of Netherlands' AVEBE and its factories in Germany was 11.19%, and that of other EU enterprises' was 11.19%. This case is China's first anti-subsidy investigation into imported commodities from the EU.

From May 19, 2011, importers of EU potato starch should pay China Customs temporary anti-subsidy duty deposit as per the ad valorem subsidy rates preliminarily ruled in this case.

The involved commodity in this case is potato starch, also known as native potato starch, refined potato starch, etc. mainly used in food industry in China, and under China HS Code 11081300.

On June 30, 2010, the Potato Starch Committee under China's Starch Industry Association submitted to China's MOFCOM the application for anti-subsidy. And on August 30, 2010, the MOFCOM officially launched the anti-subsidy investigation.

Besides, the MOFCOM has ordered to impose from April 19, 2011 anti-dumping duties of 12.6% to 56.7% on the EU potato starch.
