Pursuant to the provisions of Anti-dumping Regulations of the People's Republic of China and based on the results of anti-dumping investigation of the Epichlorohydrin imported from and originally produced in Russia, Korea, Japan and the US, the Customs has decided to enforce provisional anti-dumping measures on the Epichlorohydrin imported from and originally produced in the aforesaid nations and made public announcement for such anti-dumping measures [Announcement No. 57 (2005) of the Ministry of Commerce of the People's Republic of China, see Attachment 1 for details)]. Matters in relation to the Customs' enforcement of aforesaid provisional anti-dumping measures are hereby announced as follows:
1. The Customs will levy anti-dumping deposit in cash for the Epichlorohydrin imported from and originally produced in Russia, Korea, Japan and the US (Tariff Serial No. 29103000) pursuant to the table of anti-dumping deposit rate for Epichlorohydrin (See Attachment 2) discriminately according to different Epichlorohydrin providers in addition to the customs duties and import value-added tax levied in line with the existing provisions as of September 21, 2005.
The formula of calculation of anti-dumping deposit in cash is as follows:
Amount of anti-dumping deposit=(duty-paid value× rate of anti-dumping deposit in cash) ×(1+ import value-added tax rate)
See Attachment 1 hereto for detailed description of the products subject to provisional anti-dumping measures.
2. Certificate of origin shall be submitted to the Customs for declaration of import of Trichloroethylene and invoices of original producers shall also be provided if the original producers of Epichlorohydrin are based in Russia, Korea, Japan or the US. In the event that the certificate of origin cannot be provided for declaration of import of Epichlorohydrin and furthermore the Epichlorohydrin cannot be determined as not originally produced in Russia, Korea, Japan or the US through inspection, the Customs will levy anti-dumping deposit for the Epichlorohydrin according to the highest rate of anti-dumping deposit in cash listed in Attachment 2 hereto; In case the Epichlorohydrin can be determined as originally produced in Russia, Korea, Japan or the US but the import unit cannot provide the invoices of the original producers and furthermore the original producers of the Epichlorohydrin cannot be determined through other legitimate and effective vouchers, the Customs will levy anti-dumping deposit for the Epichlorohydrin according to the rate of anti-dumping deposit in cash applicable to other corporations of relevant nations as listed in Attachment 2 hereto.
3. Announcement No. 9 (2001) and Decree No. 111 of General Administration of Customs shall apply to the issues related to the imposition of anti-dumping deposit in cash for the Epichlorohydrin imported duty-free for process trade.
In case of false declaration of the origins of imported Epichlorohydrin or otherwise falsification of the certificate of origin or invoice of original producers of imported Epichlorohydrin, the Customs will mete out penalties pursuant to relevant provisions.
5. General Administration of Customs will issue separate announcements on the treatment of levied anti-dumping deposit in cash according to the results of final ruling.
6. In the event that the Customs cannot determine whether provisional anti-dumping measures shall be applied to the imported merchandises similar to the products subject to provisional anti-dumping measures during the period of enforcement of provisional anti-dumping measures, the relevant enterprises may submit applications to the Ministry of Commerce which will be ruled by relevant departments of the Ministry, and the Customs shall enforce such rulings.
