China Measures on Dairy Import-Export Inspection & Quarantine

Article 8 The dairy products subject to quarantine shall be imported on the strength of China's License for Quarantine of Entry Animals & Plants.

Article 9 The dairy exporters or agents abroad shall register with the AQSIQ as per China regulations.

Article 10 The dairy importers shall register with local entry-exit inspection and quarantine agencies.

Article 11 The dairy importers or agents shall declare for inspection to local inspection and quarantine agencies by submitting documents as follows:

(1) Contracts, invoices, packing lists, bills of lading, and so on;

(2) Sanitary certificates as regulated by Article 7 herein;

(3) The dairy products imported for the first time shall be provided with test reports on items specified by China national food-safety standards.

(4) The dairy products not imported for the first time shall be provided with the copies of the test reports concerning their first-time imports as well as the test reports on items required by the AQSIQ.

(5) Where the dairy imports fail in safety and sanitary tests, their re-imports shall be provided with the test reports concerning items specified by China national food-safety standards; where the test failure are not found in five consecutive batches, their re-imports shall be provided with the copies of the test reports specified by China national food-safety standards and the test reports required by the AQSIQ.

(6) The imports of pre-packaged dairy products shall be provided with original-text label samples, corresponding Chinese translation, and Chinese label samples.

(7) The imports subject to quarantine licensing shall be provided with the License for Quarantine of Entry Animals and Plants.

(8) The imports of dairy products without national safety standard established shall be provided with the licensing documents issued by the health administrations under the State Council of China.

(9) The imports of dairy products having healthcare function shall be provided with the licensing documents issued by relevant China authorities.

(10) The imports of dairy products allegedly winning any award, honor or certification shall be provided with relevant certificates that are confirmed in diplomatic channels.

Article 12 The dairy importers shall guarantee the import compliance with China national food-safety standards and declare the categories, origins and brands of their import products.

Article 13 The package and transportation of the import dairy products shall be compliant with relevant requirements for safety and sanitation.

Article 14 The pre-packaged import products shall be provided with Chinese labels and descriptions, both of which shall be compliant with China regulations and national standards.

Article 15 The import dairy products, before their inspection-quarantine certificates are obtained, shall be stored in supervising locales that are designated by the entry inspection-quarantine agencies.

Article 16 The entry inspection-quarantine agencies shall conduct inspection and quarantine over the import dairy products in accordance with China's Law on Import & Export Commodity Inspection and Law on Quarantine of Entry-Exit Animals & Plants respectively.

Article 17 The inspection-quarantine agencies shall issue entry inspection and quarantine certificates to the compliant import products, under which the products may be put into sale and use.

Article 18 Where the import products are found unqualified, the inspection-quarantine agency may issue certificate for their disqualification;

As regards the disqualification in safety, health and environmental protection, the inspection-quarantine agency shall order the importer to destroy the import products or shall issue a return notice for the importer to return the imports;

As regards other disqualifications, the import products may be technically disposed under the supervision by the inspection-quarantine agency and may be sold or used after being re-examined as qualified.

Article 19 The dairy importers shall keep detailed records of their imports and sales for two years at least, including entry inspection and quarantine certificate numbers, product names, specifications, quantity, production dates, batch numbers, shelf life, exporter information, buyer information, and delivery dates;
