Interpretation on Administrative Measures of the Customs of the People’s Republi

For the demand of safety and convenience of international trade as well as the Customs’ risk management, China Customs implement administrative measures on the manifest of inward and outward  means of transport. In June 2005, world customs organization hold the annual meeting, during which the Framework of World Trade Safety and Facility Criterion was passed. Totally 148 countries and regions including China express the intention of carrying out this framework and Administrative measures on manifest is one of which. In addition, the implementation of this measures are also for the purpose of ensuring the safety and convenience of trade link and cracking down on illegal behavior of smugglers and making the risk analysis before the goods delivered. As the data from the third party, this manifest and related data are basically derived from various links of logistics, upon the analysis on logic and statistic of this data to choose goal with high risk.
 

 For the inbound means of transport with goods and articles, the manifest transferring person shall offer major data of original manifest to Customs on the following time limitation:

(1)    24 hours before the shipment of the container ship or the non-container ship arriving at the first port of destination when entering the country

(2)    No more than 4 hours flight and before the aircraft taking off; No more than 4 hours flight and 4 hours before the aircraft arriving at the first port of destination when entering the country

(3)    2 hours before the train arriving at the first station of destination when entering the country

(4)    1 hour before the road vehicles arriving at the first station of destination when entering the country
 

The consignee and entrusted declaration agent can apply for declaration formality for goods and articles after transferring major data of original shipping bill to the customs. The major data and other data in original shipping bill and advanced manifest, when applying for the major data and item, can make a declaration simultaneously. Within the time limitation of regulation on administrative measures of manifest and on the precondition that the declaration form is not cancelled, the major data and item can be modified according to the manifest and the message can also be modified or covered freely. If many carriers sharing the same vessel, the sharing vessel can be declared by many companies but must use the same IMO and flight number.
 

The verification and cancellation of advanced manifest are in the following ways: one declaration form corresponding to one advanced manifest and many declaration forms corresponding to one advanced manifest. The customs lease means of transport on the condition that the weight or accumulated weight in declaration form must conform to that in manifest accordingly in the upwards ways.. The domestic consignor can modify the manifest according to the paper manifest after the declaration. Empty container can make a declaration before the ship reaching port of destination according to the companies' own circumstances.
