Article 8 The following minor processing or treatments do not affect the determination of the origin of goods:
1. Such treatments as desiccation, freezing, ventilation, drying, cooling or being put into salt or sulfur dioxide, being preserved in saline water or other water solutions and removal of damaged parts to keep goods in good conditions in the process of transportation or storage;
2. Dedusting, sifting, categorization, classification, matching up (combination of set of articles), cleaning, painting and cutting;
3. Variation of packaging, unpackaging and wrapping up;
4. Simple cutting, slicing and re-packaging or bottling, bagging, boxing, fixing into cardboard or wood board;
5. Pasting logo, label or other similar distinguishing marks on products or their packages;
6. Simple interminglement;
7. Simply assembling parts of products into whole products;
8. Slaughtered animals;
9. Shucking, grain treatment of leather and deboning; and
10 Combination of more than two processing and treatments listed from Paragraphs 1-9 of this article.
Article 9 In time of determination of origin of goods, the goods and their packages shall be deemed as a whole provided, however, that the origin of the packages shall be determined separately if the packages shall be separately classified according to the Customs Tariff in time of declaration of import of the packages together with goods.
Article 10 In case the goods originally produced in the member states of Asia-Pacific Trade Agreement and shipped from one member state to another for exhibition are sold during or after exhibition and meet all of the following conditions, the tax rate agreed in Asia-Pacific Trade Agreement of Customs Tariff or preferential tax rate may be applied to the goods in time of customs declaration.
1. The goods have been actually transported from one member state to another which holds the exhibition;
2. The goods have been sold in the state of sending to the exhibition to the consignor of imported goods during or immediately following the exhibition;
3. The goods are under supervision of the Customs of the member state holding the exhibition during exhibition.
In time of import of the aforesaid exhibition goods, the consignor of the imported goods shall submit the certificate of origin of the goods to the Customs.
The exhibition as provided in this article includes exhibition, fair or similar exhibition and showcasing.
Article 11 "Direct Transportation" as mentioned in Article 3 hereof refers to:
1. Goods are transported not via any non-member state;
2. Goods transported via non-member states comply with all of the following conditions no matter whether the goods are transported via different means or stored temporarily:
i. Due to geographical reasons or simply the needs of transportation;
ii. The goods do not enter the fields of trade or consumption in these countries or regions;
iii. The goods are not processed in any manners except such treatments as loading, unloading or other processing for purpose of keeping the goods in good conditions.
