Measures of the Customs of the People's Republic of China for Management of Orig

Article 20 For the purpose of these Measures, the following terms shall have the following meanings:
Mineral Products" refer to mineral fuel, lubricant and relevant materials as well as ore in sand form and metal ores;
Agricultural Products" include forestry products;
"Vessels" as mentioned in Paragraph 6 of Article 4 hereof refer to fishing vessels engaged in commercial fishing, registered in one of the member states of Asia-Pacific Trade Agreement, operated by one or more civil or governmental departments of the member state of Asia-Pacific Trade Agreement or operated by the partners, enterprises or social groups registered in the member state. The civil or governmental departments of the member state shall own at least 60% of the net value of the vessel or the civil or governmental department of each member state of Asia-Pacific Trade Agreement shall own at least 75% of the net value of the vessels. In time of sharing of fishing products obtained from vessels leased according to bilateral agreements between the member states, the products can also enjoy reduction of customs tariffs.
"Processing Vessels" as mentioned in Paragraph 7 of Article 4 hereof refer to the vessels on which only the products listed in Paragraph 6 of Article 4 hereof are processed. The vessels or processing vessels operated by governmental agencies are not subject to the requirements of hanging the national flag of member state of Asia-Pacific Trade Agreement.
"Customs Valuation Agreement" refers to the Agreement on Implementation of Article 7 of GATT 1994 which is an integral part of Marrakesh Agreement on Establishment of WTO.
Article 21 These Measures shall be interpreted by General Administration of Customs.
Article 22 These Measures shall come into effect as of January 1, 2009 and Interim Provisions of the Customs of the People's Republic of China concerning the Origin of Import Goods under the First Agreement on Trade Negotiations among Developing Member Countries of the Economic and Social Council for Asia and Pacific promulgated by Decree No.94 of General Administration of Customs on December 30, 2001 shall be annulled simultaneously.
