India Issued Final Ruling on Anti-Dumping Investigation for Chinese Diethyl Thiophosphoryl Chloride, Proposing Formal Anti-Dumping Duty

The anti-dumping authority of Indian Chamber of Commerce & Industry issued a final ruling on May 6, 2010 on the anti-dumping investigation for Diethyl Thiophosphoryl Chloride (DETPC) originating from China, proposing the formal imposition of an anti-dumping duty on that product.

In the announcement of the final ruling, the anti-dumping authority continued regarding China as a country with non-market economy, and adopted the constructed price to calculate the normal value of Chinese exports without offering the market economy treatment to Chinese export enterprises. Soon afterwards, the dumping margins of 4 Chinese enterprises involved were identified from 30% to 80%, that of other Chinese enterprises from 85% to 95%.

At the same time, considering the price of raw materials, labor costs, interest rates, sales expenses and other factors, the anti-dumping authority affirmed that the Chinese exports have caused material injury to Indian domestic industry. Finally, the injury margins of 4 Chinese enterprises were identified from 15% to 60%, that of other Chinese enterprises from 85% to 95%.

Ultimately, the anti-dumping duty rates of the 4 Chinese enterprises were identified from USD 0.516 per ton to USD 1.024 per ton, that of other Chinese enterprises at USD 1.157 per ton.

According to the final ruling, each stakeholder involved may appeal against the ruling to the appellate customs court and/or tax court.
