Announcement No. 88, 2008 of the Ministry of Commerce on Initiating Anti-dumping

I. Initiation of the investigation and the investigation period
With the dumping investigation period extending from July 1, 2007 toJune 30, 2008 and the period for the investigation of industrial injury from January1, 2005 to June 30, 2008, the Ministry of Commerce decides to carry out the anti-dumping investigation into the imported Apicid acid Originating in South Korea, the European Union and the United States as of promulgation of the present Announcement.

II. Products to be investigated and investigation scope
Scope of investigation: Apicid acid originating in South Korea, the European Union and the United States
Name of the investigated product: Adipic acid (AA)
Its chemical formula: C6H10O4

Chemical structural formula: HOOC(CH2)4COOH, as shown in the following figure

Physical and chemical characteristics: Adipic acid belongs to the aliphatic dicarboxylic acids, and it appears to be white crystalline powder generally, stable, non-toxic, slightly soluble in water and in ether, soluble in benzene.

Main applications: Adipic acid can be mainly used for both nylon products and non-nylon products. When used for nylon products, the adipic acid can, through condensation reaction with hexamethylene diamine, form nylon-66 salts, which can be put into further reaction to produce nylon-66 fibers and nylon-66 resins; when used for non-nylon products, the adipic acid can form polyester polyols through condensation reaction with polyols for further production of various kinds of polyurethane products such as polyurethane resins for shoe soles, polyurethane resins for synthetic leathers, polyurethane adhesives, thermoplastic urethanes(TPU), polyurethane rubber and polyurethane foam, etc. Besides, the adipic acid can be used in plasticizer making, unsaturated polyester resin making and other fields.

The investigated product is classified under Tariff No. 29171200 in the Customs Tariff of Import and Export of the People's Republic of China.

III. Register for Responding
As for the anti-dumping investigation, any interested party may apply for defending with the Bureau of Fair Trade for Imports and Exports of Ministry of Commerce within 20 days after this announcement is issued, and the exporter or producer concerned shall provide the volume and value of products concerned it exported to China from July of 2007 to June of 2008. The Registration Form for Anti-dumping Response can be downloaded from the " Announcement" column on the website of the Bureau of Fair Trade for Imports and Exports of the Ministry of Commerce: http://gpj.mofcom.gov.cn.

As for the industry injury investigation, the interested party may apply for anti-dumping response with the Bureau of Industry Injury Investigation of the Ministry of Commerce within 20 days after this announcement is issued, providing information relevant to production capacity, output, inventory, project under construction and expansion plans during the industry injury investigation period, as well as the volume and value of products to be investigated they exported to China during such period.
