Announcement No. 89, 2008 of the Ministry of Commerce on Initiating Anti-dumping

I. Initiation of the investigation and the investigation period
With the dumping investigation period extending from April 1, 2007 to March 31, 2008 and the period for the investigation of industrial injury from January1, 2005 to June 30, 2008, the Ministry of Commerce decides to carry out the anti-dumping investigation intothe imported Polyamide-6,6 originating in the United States, Italy, Britain, France and Taiwan as of promulgation of the present Announcement.
II. Products to be investigated and investigation scope
Scope of investigation: the imported Polyamide-6,6 originating in the United States, Italy, Britain, France and Taiwan
Name of the investigated product: full name: polyhexamethylene adipamide(short for polyamide-6, 6)
Its chemical formula:[NH (CH2)6-NH-CO-(CH2)4-CO] n
Physical and chemical characteristics: milky white translucent or opaque crystalline polymer
Main applications: the polyamide-6, 6 is a kind of synthetic resin, which is widely used in injection molding, filature, modification, etc. and is one of applied materials in electronics, military industry, automobile, railway parts, textile and other fields.
The investigated product is classified under Tariff No. 39081011 in the Customs Tariff of Import and Export of the People's Republic of China.
III. Register for Responding
As for the anti-dumping investigation, any interested party may apply for defending with the Bureau of Fair Trade for Imports and Exports of Ministry of Commerce within 20 days after this announcement is issued, and the exporter or producer concerned shall provide the volume and value of products concerned it exported to China from July of 2007 to June of 2008. The Registration Form for Anti-dumping Response can be downloaded from the "Announcement" column on the website of the Bureau of Fair Trade for Imports and Exports of the Ministry of Commerce: http://gpj.mofcom.gov.cn.
As for the industry injury investigation, the interested party may apply for anti-dumping response with the Bureau of Industry Injury Investigation of the Ministry of Commerce within 20 days after this announcement is issued, providing information relevant to production capacity, output, inventory, project under construction and expansion plans during the industry injury investigation period, as well as the volume and value of products to be investigated they exported to China during such period. The Application Form for Response to the Industry Injury Investigation into Polyamide-6,6 can be downloaded from the "Anti-dumping Registration" column on the website of China Trade Remedy Information: http://www.cacs.gov.cn.
IV. Failure to register for defending
If the interested party fails to register for defending with the Ministry of Commerce within the required period, the Ministry of Commerce shall have the right to reject the materials submitted subsequently, and make a judgment according to information available to it.
V. Rights of the interested parties
Interested parties can submit their written opinions to the Ministry of Commerce within 20 days as of the date when the Announcement is issued if they have objections to the qualification of the applicants, the investigated products, investigation range and other related issues.
Interested parties can look up the non-confidential version of the application handed in by the applicant at Open Information of Anti-dumping Look-up Office of the Ministry of Commerce during the above-mentioned period.
