The U.S. Department of Commerce Slashes Anti-dumping Duty on Pangasius Imports

The US Department of Commerce (DOC) has announced its final decision on the seventh preliminary results of administrative review (POR7) for anti-dumping duties on Vietnamese tra fillet imports, the Vietnam Trade Bureau in the US informed.

The new figures come from review proceedings on Vietnamese frozen pangasius fillets for the period between 1 August 2009 and 31 July 2010.

Vietnam was fortunate that DOC chose Bangladesh as the sole replacing country in calculating the anti-dumping rate instead of both Indonesia and Bangladesh as in the previous PORs, Tuoi Tre reports.

As the US does not recognise Vietnam as a market economy, the US uses a third nation – in this case Bangladesh – that it recognises as a market economy and as the surrogate country to settle on anti-dumping tariffs for Vietnam.

The agency decided to impose a rate of USD 0.00 per kg on Vietnamese exporting company Vinh Hoan and USD 0.03 per kg on 12 additional firms. Other companies will have to pay a tax rate of USD 2.11 per kg.

Last September, the DOC determined that the tax rate for Vinh Hoan stood at zero and that the duty for others would rocket 28 times from USD 0.02 per kg to USD 0.56 per kg.

The US House of Representatives this month approved the draft law on new taxes compulsory on imports worth millions of USD from China and other countries whose economies the US considers have no market status, VNA reports.

According to the DOC, these tariffs are implemented on 23 Chinese commodities and one Vietnamese commodity worth USD 4.7 billion in import value each year.

The US will get rid of these tariffs in mid-March as a result of a US federal court of appeal which recently ruled that the agency lacks a legitimate right to impose these anti-dumping taxes. Congress will not be involved.

Importers will now have to "file a certificate regarding the reimbursement of antidumping duties prior to the liquidation of the relevant entries during this POR," a DOC notice mandated, Thanh Nien News reports.
