Announcement No.115, 2008 of the Ministry of Commerce on Initiation of Anti-dump

The Ministry of Commerce of the People's Republic of China received an anti-dumping investigation application submitted by the Fastener Professional Association of China General Machine Components Industry Association on behalf of domestic carbon steel fastener producers, who requests for an anti-dumping investigation into certain iron and steel fasteners originally produced in European Union countries.

The Ministry of Commerce, in accordance with relevant provisions of the Regulations of the People's Republic of China on Anti- dumping, has examined qualifications of the applicant, relevant information about the products into which we are expected to investigate, relevant information about similar products in China, impact of the products into which to be investigated on the domestic industry, relevant information about the country or region as origin of such products, as well as evidences involving the alleged dumping, injury and causality between them. The prima facie evidences provided by the applicant show that the Fastener Professional Association of China General Machine Components Industry Association as the applicant, and Guangdong Province Fastener Association, Ningbo Fastener Association, Wenzhou Fastener Association, Jiaxing Fasteners Import & Export Manufacturers Association Yongnian Fastener Association who all support the application, produced more than 50% of all fasteners in China in 2007 and in the period from January to June, 2008, which conforms to the regulations about anti-dumping investigation application by domestic industry as stipulated in Article 11, 13, 17 in the Regulations of the People's Republic of China on Anti- dumping. Meanwhile, the application contains the contents and relevant evidences required by the initiation of anti-dumping investigation, as stipulated in Article XIV, XV in the Anti-dumping Regulations of the People's Republic of China

Therefore, based on the above examination and requirements of Article 16 in the Regulations of the People's Republic of China on Anti- dumping, the Ministry of Commerce has decided to initiate an anti-dumping investigation into certain imported iron or steel fasteners originally produced in European Union countries as of December 29, 2008. Matters concerning this investigation are hereby announced as follows:

I. Initiation of the investigation and the investigation period
As of the issuing date of this announcement, the Ministry of Commerce formally started the anti-dumping investigation into certain iron or steel fasteners imported from the European Union countries, with the anti-dumping period to be investigated being from July 1, 2007 to June 30, 2008, and industrial injury period from January 1, 2005 to September 30, 2008.
