MOFCOM Announcement 111 on Catalog of Exp-Licensed Goods by Grade

Announcement No. 111, 2010 of the Ministry of Commerce of China (MOFCOM)

According to the Administrative Measures on Export Licenses for Goods (the MOFCOM's Decree No. 11, 2008) and the Catalog for 2011 of Goods Exported by Export License (Announcement No. 108, 2010 by the MOFCOM and the GACC), hereby promulgated are the Catalog for 2011 of Goods under Export Licenses by Grade (annexed below) and relevant matters:

1. Totally 49 kinds of goods are to be subject to export licenses in 2011. Export licenses for these goods may be signed and issued by the MOFCOM's Bureau of Quota License Affairs (below referred to as the License Bureau), local offices of the MOFCOM's commissioners (below referred to as commissioner offices), and the certifying organs under local commerce authorities authorized by the MOFCOM (below referred to as local certifying organs).

(1) The License Bureau may take charge of signing and issuing export licenses for the following six kinds of goods: corn, wheat, cotton, coal, crude petroleum, and petroleum products.

(2) Commissioner offices may take charge of signing and issuing export licenses for the following 32 kinds of goods:

Rice, corn flour, wheat flour, rice flour, sawn lumber, live cattle, live pig, live chicken, coke, rare earth, antimony and its product, tungsten and its product, zinc ore, tin and its product, silver, indium and its product, molybdenum, phosphate ore;

Juncaceae and its product, silicon carbide, talc lump/powder, sintered magnesia, alumina, licorice and its product;

Iced fresh beef, frozen beef, iced fresh pork, frozen pork, iced fresh chicken, frozen chicken, platinum (export by processing trade), natural sand (incl. standard sand).

(3) Local certifying organs may take charge of signing and issuing export licenses for the following 11 kinds of goods:

Ozone depleting substances, paraffin wax, zinc and zinc base alloy, part of metals and their products, automobile (incl. kit of parts) and its chassis, motorcycle (incl. all terrain vehicle) and its motor/frame, molybdenum product, citric acid, penicillin industrial salt, vitamin C, and sodium disulphate.

2. The License Bureau may take charge of signing and issuing export licenses to central governmental enterprises located in Beijing Municipality.

3. Part of export goods may be designated to specific certifying organs for license or specific ports for clearance. Where exporting such goods, enterprises concerned shall obtain in advance the export licenses from designated certifying organs and make customs declaration at designated ports. The certifying organs shall sign and issue export licenses based on designated ports.

(1) Antimony and its products may be designated for export declaration to Huangpu Customs, Beihai Customs, and Tianjin Customs.

(2) With respect to 70%-content magnesium oxide compounds (HS Code 3824909200), relevant export licenses may be signed and issued by commissioner offices without being designated to specific ports for customs declaration;

With respect to other sintered magnesia products, relevant export licenses may be signed and issued by the commissioner office at Dalian and be designated for declaration to Dalian Customs, Qingdao Customs, Tianjin Customs, Changchun Customs, and Manzhouli Customs.

(3) With respect to licorice, relevant export-declaration ports may be restricted to Tianjin Customs, Shanghai Customs, and Dalian Customs;

As to its products, relevant export-declaration ports may be restricted to Tianjin Customs and Shanghai Customs.

(4) With respect to live cattle, live pig and live chicken for export by land to Hong Kong/Macao, relevant export licenses may be signed and issued by the commissioner offices located at Guangzhou or Shenzhen.

(5) With respect to re-export sawn lumber processed with imported logs, relevant export licenses may be dealt with as the following:

Heilongjiang provincial authority of commerce may sign and issue for enterprises located in that province, and declaration ports may be restricted to Dalian Customs and Suifenhe Customs;

Inner Mongolia regional authority of commerce may sign and issue for enterprises located in that region, and declaration ports may be restricted to customs authorities at Manzhouli, Erenhot, Dalian, Tianjin, and Qingdao;

Xinjiang regional authority of commerce may sign and issue for enterprises located in that region, and declaration ports may be restricted to customs authorities at Alashankou, Tianjin, and Shanghai;

Fujian Provincial Department of Foreign Trade & Economic Cooperation may sign and issue for enterprises located in that province, and declaration ports may be restricted to customs authorities at Fuzhou, Xiamen, Putian, and Zhangzhou.

(6) Commissioner offices in Guangdong and Hainan Provinces may take charge of signing and issuing export licenses for natural sand to their local enterprises exporting to Hong Kong, Macao, or Taiwan regions, and the commissioner office in Fujian Province may take charge of the export licenses for natural sand to its local enterprises exporting to Taiwan region;

The declaration ports may be restricted to provincial customs authorities over relevant enterprises.

The commissioner office at Fuzhou City may take charge of signing and issuing export licenses for standard sand.

4. With respect to re-export of sawn lumber processed with imported logs, according to relevant regulations, any eligible enterprises shall obtain in advance the export licenses from the certifying organs specified in the item (5) under Article 3 above mentioned on the strength of the Certificate for Exporting Sawn Lumber Processed with Imported Logs.

The specified certifying organs shall fill in the remarks column of the licenses with "Sawn Lumber Processed with Imported Logs".

5. The system of "one license for each batch" shall apply to export licenses for ozone depleting substances.

6. All of the License Bureau, commissioner offices and local certifying organs shall sign and issue export licenses in strict accordance with the Administrative Measures on Export Licenses for Goods, the Catalog for 2011 of Goods Exported by Export License, and the Specifications on the Signing and Issuing of Export Licenses (ShangPeiFa〔2008〕No. 398).

This Catalog shall take effect from January 1, 2011 with simultaneous repeal of the Catalog for 2010 of Goods under Export Licenses by Grade.
