GACC Announcement 11, 2011 on Goods-Flow Certificate

Announcement No. 11, 2011 of the General Administration of Customs of China (GACC)

According to the Framework Agreement of Comprehensive Economic Cooperation between China and the ASEAN and the Administrative Measures of the Customs of the P. R. China on Place of Origin of Import & Export Goods under the Framework Agreement of Comprehensive Economic Cooperation between China and the ASEAN, this Announcement hereby specify relevant matters on issuance of the Certificate of Goods Flow by China Customs:

1. The "Certificate of Goods Flow" described in this Announcement refers to a kind of certificate signed and issued by China Customs on goods from any of ASEAN states, which are involved in transportation via China’s customs territory to other member states within China-ASEAN Free Trade Area, pertaining to certification that the goods concerned conform with the qualification of origin in ASEAN states as per the China-ASEAN Free Trade Agreement covered Certificate of Origin (FORM E) issued by certifying authorities of ASEAN states.

2. The operator of aforesaid transportation may apply to China Customs for issuance of the Certificate of Goods Flow, if complying with all of the following conditions:

(1) Such goods are throughout supervised by customs and are free of any processing or disposal except being loaded, unloaded, or carried when necessary.

(2) The consignee declaring the entry of such goods is also the consignor declaring the exit of such goods.

(3) The consignor declaring the exit of such goods has made an electronic or paper-written application to China Customs for issuance of the Certificate of Goods Flow.

3. The consignor, required to apply for the Certificate of Goods Flow, shall make the application in electronic or paper form to China Customs certifying organs prior to his declaration for export and shall also submit the following required documents:

(1) A truthfully completed Application Form for the Certificate of Goods Flow;

(2) Original Certificates of Origin issued by authorities of ASEAN countries/regions of goods origin;

(3) Export goods related commercial invoices, contracts, bills of lading, and other documents;

(4) Documents directly evidencing that the goods concerned are throughout supervised by customs, including Customs Declaration Forms and Lists of Archived Materials;

(5) Other certifying documents required by China Customs.

4. The applicant shall, according to China-ASEAN Free Trade Area rules of origin and regulations on the back of the Certificate of Goods Flow, fill in truthfully, clearly and accurately all required columns in the Application Form for the Certificate of Goods Flow.

Columns in the first page thereof shall be completed in Chinese, and those in the second page shall be completed in English.

Where the applicant fails to complete this Application Form as per requirements, the Customs may reject his application for the Certificate of Goods Flow.

5. After examining and deeming the in-filled Application Form compliant with requirements, the Customs may sign and issue the Certificate of Goods Flow to the applicant within five workdays from the date of application acceptance.

The original and third copies of the Certificate of Goods Flow shall be issued to the applicant, and the second copy thereof shall be kept on file with customs certifying organs.

Issuance of the Certificate of Goods Flow shall be effected within one year from the date of issuance of relevant Certificate of Origin, and validity period of the Certificate of Goods Flow shall be consistent with that of relevant Certificate of Origin.

6. Where the Certificate of Goods Flow is stolen, lost, or damaged, exporters may apply in writing to customs authorities that are issuers of the former Certificate of Goods Flow for issuance of approved copies of the original and third copies of the former Certificate.

The exporters shall provide to relevant customs the third copy of the former Certificate of Goods Flow or any documents certifying the issuance of the former Certificate.

The approved copies of the Certificate of Goods Flow shall be issued within one year from the date of issuance of relevant Certificate of Origin, and validity period of such copies shall be consistent with that of relevant Certificate of Origin.

7. Where export destination is changed in the course of transportation to the importer specified in the Certificate of Goods Flow, exporters may apply in writing to relevant customs for re-issuance of the Certificate of Goods Flow by submitting the issued former Certificate of Goods Flow.


Contents of this Announcement shall come into effect from the date of its issuance.
