Announcement No. 22 of 2012 of the Ministry of Commerce of the People's Republic of China on the Termination of Anti-dumping Measures Against Methyl Ethyl Ketone

The Ministry of Commerce of the People's Republic of China, released on November 21, 2007, its Announcement No. 81 of 2007, deciding to levy anti-dumping duties on imported Methyl Ethyl Ketone (HS Code 29141200) originated from Japan, Taiwan, and Singapore from November 22, 2007 to November 21, 2012.

According to Article 48 of the Anti-dumping Regulations of the People's Republic of China, the period for the levy of an anti-dumping duty and fulfillment of a price undertaking shall not exceed five years, however, if a review determines that the termination of the anti-dumping duties may result in the continuation or recurrence of the dumping and injury, the time limit for the levy of anti-dumping duties may reasonably be extended.

Domestic industry or natural person, legal person or relevant organizations that represent domestic industry could submit written petition on final review to the Ministry of Commerce 60 days prior to the termination date. And the petition shall make clear on the demand of final review, and shall contain related evidences of that the termination of the anti-dumping duties may result in the continuation or recurrence of the dumping and injury.

If there is no petition from domestic industry or natural person, legal person or relevant organizations that could represent domestic industry, and the Ministry of Commerce does not take initiative in final review on such anti-dumping measures, the said measures will be terminated on November 22, 2012.
