MOFCOM Announcement No. 37, 2012 on Renamed S. Korean Company of Dispersion Unshifted Single-Mode Fibers

On December 31, 2010, the MOFCOM issued its Announcement No. 92 of 2010 to sustain Chinese antidumping measures on Dispersion Unshifted Single-Mode Optical Fibers originating in Japan and South Korea with the antidumping duty rate of 2.3% imposed on South Korean company OPTOMAGIC.
On April 17, 2012, South Korean company TAIHAN Fiberoptics Co., LTD., which is renamed from OPTOMAGIC, applied to the MOFCOM for its inheritance of the rights and obligations of OPTOMAGIC in the antidumping measures upon submission of relevant documents in connection with its renaming.
On May 17 and June 14, 2012, TAIHAN Fiberoptics Co., LTD. additionally submitted the list of its affiliated parties, capacity and output comparison, distribution channels before and after its renaming as well as other renaming evidences.
The MOFCOM has notified Chinese antidumping petitioners of the South Korean company's application, and the Chinese antidumping petitioners have indicated no objection to the company's renaming.
The MOFCOM holds that OPTOMAGIC is evidenced to have been renamed to TAIHAN Fiberoptics Co., LTD. and there is no change before and after its renaming in terms of the management, production, raw material supply, distribution and customer base regarding the investigated products herein.
Now therefore, the MOFCOM decides:
1. TAIHAN Fiberoptics Co., LTD. shall inherit the rights and obligations of previous OPTOMAGIC (OPTOMAGIC CO., LTD.) regarding the antidumping measures on Dispersion Unshifted Single-Mode Optical Fibers that are subject to the antidumping duty rate of 2.3%.
2. The investigated products exporting to China in the name of OPTOMAGIC (OPTOMAGIC CO., LTD.) shall be subject to the antidumping duty rate of 46% applied to "other South Korean companies" covered by the antidumping measures.
This Announcement shall take effect from July 16, 2012.
