MOFCOM Announcement No. 45, 2012 for AD Midterm Review on Chloroprene Rubber from Japan

On May 10, 2005, the MOFCOM issued its annual Announcement No. 23 to levy antidumping (AD) duties on chloroprene rubbers originating in Japan, the U.S. and the EU from then on.

On August 25, 2010, the MOFCOM issued its annual Announcement No. 49 concerning its midterm-review ruling on Japan-made chloroprene rubbers which adjusts the applicable antidumping duty rates.

On May 9, 2011, the MOFCOM issued its annual Announcement No. 21 concerning its final review ruling to sustain the antidumping measures for five years from May 10, 2011 as per its Announcements No. 23, 2005 and No. 49, 2010.

On June 8, 2012, Chongqing Changshou Chemical Co., Ltd. and Shanxi Synthetic Rubber Group Co., Ltd., representing Chinese chloroprene rubber industry, formally petitioned the MOFCOM to conduct a midterm review for dumping practice and dumping margin on Japan's DENKA company.

Within a time limit, the MOFCOM received submissions from Japan's DENKA and from China's adhesive and automobile industrial associations respectively.

According to China's Antidumping Regulations and Midterm-Review Rules On Dumping And Dumping Margin, the MOFCOM has made inspections over the Chinese petitioner qualification, the targeted import goods, the export price and normal product value from the targeted origin, and so on.

Based on its inspection results, the MOFCOM thinks the petitioners are eligible to represent the domestic industry and their propositions and evidences are compliant with requirements for starting a midterm review.

Therefore, the MOFCOM has decided to start from August 8, 2012 the midterm review for dumping and dumping margin on chloroprene rubbers supplied by Japan's DENKA company.

Relevant matters are hereby announced:

Ⅰ Product Scope

The review scope covers the import chloroprene rubbers supplied by Japan's DENKA company, and the product description is consistent with those in MOFCOM Announcements No. 23 of 2005, No. 49 of 2010 and No. 21 of 2011.

Product Name: Chloroprene Rubber

1. Product Description: milk white-off white or light brown flakes or lumps, without mechanical sundries other than talcum powder, no scorching particles; homopolymer made by emulsion polymerization of 2-chlorine-1, 3-butadiene; molecular weight generally at 100,000-200,000, relative density at 1.15-1.25, glass transition temperature at -45℃; having heteropolarity, regular molecular arrangement and reversible crystallinity.

2. Main Usage: used for electric wire sheath, rubber hose, oil resistant rubber, heatproof conveyor belt, rubber stick, rubber dam, sealing strip, bridge pad, tarpaulin, anti-flaming rubber, seal ring, antiseptic lining, rubber-based adhesives, water-proof materials, and so on.

3. Chinese HS Codes: 40024910 other primary-form chloroprene rubbers, 40024990 unnamed chloroprene rubbers.

Ⅱ Investigation Period and Scope

1. Investigation period for the review is April 1, 2011 till March 31, 2012.

2. Investigation scope for the review is the antidumping duty rate applicable to the chloroprene rubbers supplied by Japan's DENKA company.

Ⅲ Review Procedure

1. Remarks by Interested Parties

Any interested parties may, within twenty days from the issue date herein, submit to the MOFCOM their written remarks on the review, which may be attached with relevant evidences.

2. Issuance of Questionnaire

To obtain necessary information for the investigation, the MOFCOM will send questionnaire to relevant interested parties; answers to the questionnaire shall be submitted to the MOFCOM as required within thirty-seven days following the questionnaire sending date.

3. Public Hearing

The interested parties may, as per the MOFCOM's hearing rules, request in writing the MOFCOM to hold a public hearing for the review; the MOFCOM may also initiate a hearing where necessary.

4. Onsite Inspection

The MOFCOM may dispatch personnel to conduct onsite inspections at home and abroad; any submissions of the interested parties shall include their written agreement on the MOFCOM's onsite inspections; and before such onsite inspections, the MOFCOM will inform in advance the countries, regions and enterprises to be inspected.

Ⅳ Noncooperation

Where any interested party fails to provide truthful information or conditions within a reasonable time or hinders the investigations by any other means, the MOFCOM may make relevant rulings based on acquired facts and acquirable best information.
