MOFCOM Announcement No. 68, 2012 on New Exporter Review for Nissan North America, Inc.

On December 14, 2011, the MOFCOM issued its annual Announcement No. 84 deciding to levy two-year antidumping and anti-subsidy duties on U.S.-made cars and sports utility vehicles (SUV) both with not less than 2.5-liter displacement.

On September 3, 2012, Nissan North America, Inc. applied in writing to the MOFCOM for reviewing the incorporation as a new exporter to China.

In accordance with China's antidumping and anti-subsidy regulations, the MOFCOM hereby decides to start, as of the issue date herein, a review for new exporter on the cars and SUVs from Nissan North America, Inc.

Relevant matters are announced below:

Investigated Products

Import cars and sports utility vehicles (SUV) both with not less than 2.5-liter displacement, originating in the U.S., under Chinese HS Codes 87032361, 87032362, 87032369, 87032411, 87032412, 87032419, 87032421, 87032422, 87032429, 87033311, 87033312, 87033319, 87033321, 87033322, 87033329, 87033361, 87033362, 87033369, 87039000.

Investigation Period and Scope

(1) Investigation periods: The dumping investigation period is from March 1, 2012 till August 31, 2012, and the subsidy investigation period is from September 1, 2011 till August 31, 2012.

(2) Investigation scope: the applicant's eligibility as a new exporter; the existence and margin of any dumping and subsidy of the investigated products that are exported by the applicant.

Rights of Interested Parties

Where any interested party has any objections concerning this investigation, it may submit its opinions in writing to the MOFCOM within twenty (20) days from the issue date of this Announcement.

Any interested party may refer to the non-confidential copy of the written application for the review at the MOFCOM's open information inquiry office (tel. 8610-65197878).

Investigation Modes

The MOFCOM may conduct the investigation with interested parties by means of questionnaire issuance, sampling, public hearing, and onsite inspection.

Time Limit

This review shall start from October 18, 2012 and terminate by July 18, 2013.

Noncooperation Consequence

Where any interested party fails to provide truthful information or conditions within a reasonable time or hinders the investigations by any other means, the MOFCOM may make relevant rulings based on acquired facts and acquirable best information.

Cash Deposit

From October 19, 2012, relevant importers shall, upon their imports of the investigated products from Nissan North America, Inc., submit cash deposit at the antidumping or anti-subsidy rates specified for "other U.S. companies" in the MOFCOM Announcement No. 84 of 2011.
