China Tariffs Implementation Plan for 2013

Notice No. 22, 2012 of the Customs Tariffs Commission of the State Council of China
 
To the General Administration of Customs of China (GACC):

Upon approval by the State Council, China Tariffs Implementation Plan for 2013 has been adopted by the Customs Tariffs Commission and shall come into force from January 1, 2013.

China Tariffs Implementation Plan for 2013

Ⅰ Import Tariff Adjustments:

1. Most-Favored Nation (MFN) Tariffs:

(1) Nine information-technology products with "ex" HS Codes shall be subject to customs examination and original duty rates; their "ex" HS Codes are increased to 10 codes. (See Annex 1)

(2) Tariff quotas may be continued on 8 kinds of commodities as wheat under 47 HS Codes at original duty rates;

Sliding-scale duties may be applied to certain cotton imports beyond the quotas, and relevant formula parameters may be adjusted;

The quota duty at 1% may be applied to three chemical fertilizers including urea, compound fertilizers and diammonium hydrogen phosphate.

(3) Specific duties or compound duties at original rates may be continued on 47 commodities as photosensitive materials, and ad valorem duties may be applied to five photosensitive materials. (See Annex 3)

(4) Other MFN duty rates may remain unchanged.

2. Provisional Tariffs:

Provisional duty rates may be applied to 784 import goods including fuel oils. (See Annex 4)

3. Conventional Tariffs:

Conventional duty rates may be applied to the countries/regions in agreement with China on trade or tariff preferences (see Annex 5):

(1) The conventional tariffs under the Asia-Pacific Trade Agreement may be applied to 1,875 HS Code-covered goods from South Korea, India, Sri Lanka, Bangladesh and Laos;

(2) The conventional tariffs under China-ASEAN Free Trade Agreement may be applied to part of HS Code-covered goods from Brunei, Indonesia, Malaysia, Singapore, Thailand, the Philippines, Vietnam, Myanmar, Laos and Cambodia;

(3) The conventional tariffs under China-Chile Free Trade Agreement may be applied to 7,308 HS Code-covered goods from Chile, and some duty rates under the Agreement may be lowered further;

(4) The conventional tariffs under China-Pakistan Free Trade Agreement may be applied to 6,509 HS Code-covered goods from Pakistan;

(5) The conventional tariffs under China-New Zealand Free Trade Agreement may be applied to 7,319 HS Code-covered goods from New Zealand;

(6) The conventional tariffs under China-Singapore Free Trade Agreement may be applied to 2,961 HS Code-covered goods from Singapore;

(7) The conventional tariffs under China-Peru Free Trade Agreement may be applied to 7,085 HS Code-covered goods from Peru;

(8) The conventional tariffs under China-Costa Rica Free Trade Agreement may be applied to 7,281 HS Code-covered goods from Costa Rica;

(9) Zero duty may be applied to 1,760 HS Code-covered goods from Hong Kong SAR under mainland preferential origin criteria;

(10) Zero duty may be applied to 1,271 HS Code-covered goods from Macao SAR under mainland preferential origin criteria;

(11) The conventional tariffs under the "Early Harvest Program" of the cross-straits Economic Cooperation Framework Agreement may be applied to 614 HS Code-covered goods from Taiwan region.

4. Special Preferential Tariffs:

Special preferential duty rates may be applied to some HS Code-covered goods from 40 least-developed countries/regions recognized by the UN including Ethiopia, Benin, Burundi, Eritrea, Djibouti, Congo, Guinea, Guinea-Bissau, Comorin, Liberia, Madagascar, Mali, Malawi, Mauritania, Mozambique, Rwanda, Sierra Leone, Sudan, Tanzania, Togo, Uganda, Zambia, Lesotho, Chad, Central Africa, Afghanistan, Bangladesh, Nepal, East Timor, Yemen, Samoa, Vanuatu, Equatorial Guinea, Angola, Senegal, Niger, Somali, Laos, Myanmar and Cambodia (see Annex 6).

5. General Tariffs:

General duty rates may remain unchanged.

Ⅱ Export Tariff Adjustments

1. The export duties in the "Export Tariff Schedule" may remain unchanged;

2. Provisional duty rates may be applied to such exports as ferrochrome; and special export duties may be applied to some chemical fertilizers. (See Annex 5)

Ⅲ Tariff Item Adjustments

Some of tariff items are adjusted (see Annex 6); and after the adjustment, there are 8,238 items in the tariff schedules of 2013.

This Plan shall come into force from January 1, 2013.
