China Measures on Cotton Import Inspection

Article 29 The spot inspection locales shall meet the conditions below:
(1) Being suitable for cotton storage;
(2) Having equipment and personnel for unpacking, weighing and sampling;
(3) Having other inspection facilities required
Article 30 The inspection-quarantine agencies shall conduct spot inspection over the import cotton in terms of both the goods state and their documents, packages, and container lead seals.
Article 31 The inspection-quarantine agencies shall conduct inspection in terms of quantity, weight, quality, and damage and issue relevant certificates.
Article 32 Where having objection to the official inspections, the consignee or consignor may apply for re-inspection as regulated.
Chapter 5 Supervision
Article 33 The external suppliers shall continuously maintain an effective quality control system. The AQSIQ may conduct onsite inspection over the external suppliers.
Article 34 The consignee shall keep records of sale, use and claims for import cotton, and the inspection-quarantine agency may examine the consignee's records thereof.
Article 35 The inspection-quarantine agency shall keep records of quality and credit assessments and goods inspections.
Article 36 Upon any of the following acts by the registered external suppliers, the AQSIQ shall revoke the registration of the external suppliers, who shall re-apply for registration after six months from the revocation date.
(1) Submission of false materials for registration;
(2) Failure in quality control system to guarantee cotton quality;
(3) Registered Grade C suppliers act as the circumstances listed by Article 20 herein;
(4) Refusal of the supervision
Chapter 6 Legal Liabilities
Article 37 Upon any of the following acts by the consignees, where any illegal gain arises, the inspection-quarantine agency shall impose a penalty of not more than three times the illegal gain but not more than CNY 30,000 at most; where any illegal gain does not occur, the penalty shall be not more than CNY 10,000:
(1) Failure to keep records of sale, use and claims for import cotton;
(2) Any serious consequences from failure to provide true information of import cotton;
(3) Refusal of the supervision
Article 38 Upon any other violations by the external suppliers, the inspection-quarantine agency shall resort to relevant China laws and regulations.
Article 39 Upon abuse, irregularity, counterfeiting, and other misconducts by the inspection-quarantine agency or its staff, the external suppliers may resort to relevant upper China authorities for justice.
Chapter 7 Supplementary Provisions
Article 40 The quarantine of the import cotton shall be conducted in accordance with China's governing laws and regulations.
Article 41 These Measures shall govern the cotton suppliers from Hong Kong, Macao, and Taiwan regions.
Article 42 Relevant regulations may govern the imports from abroad to any bonded zones, export processing zones and other customs-supervised zones.
Article 43 These Measures shall be construed by the AQSIQ hereto.
Article 44 These Measures shall enter into force on February 1, 2013.
