AQSIQ Requirements on Tajikistan Cherry Quarantine

Whereas China and Tajikistan have reached the Protocol on Phytosanitary Requirements over Fresh Cherry Exported from Tajikistan to China, the AQSIQ hereby announces that, as of June 17, 2013, permission shall be granted to the importation of cherry from Tajikistan in compliance with the Phytosanitary Requirements on Cherries Imported from Tajikistan (see the annex hereto) .

Annex: Phytosanitary Requirements on Cherries Imported from Tajikistan

Article 1 Legal Ground

(1) P. R. China's Law and Regulations on Quarantine of Entry-Exit Animals and Plants;
(2) P. R. China's Law and Regulations on Food Safety;
(3) Measures on Inspection and Quarantine of Entry Fruits (AQSIQ Decree No. 68 of 2005) ;
(4) Protocol on Phytosanitary Requirements over Fresh Cherry Exported from Tajikistan to China

Article 2 Commodity Description:
Scientific name: Prunus avium; English name: Fresh Cherry

Article 3 Permitted Origin:
The territory of Tajikistan

Article 4 Approved Orchards and Package Plants:

The cherry orchards and package plants involved in the export shall be registered with Tajikistan Ministry of Agriculture and their registration information shall be provided to the AQSIQ hereto.

Article 5 Quarantine Pests Concerned:
(1) Lobesia botrana;
(2) Rhagoletis cerasi;
(3) Verticillium dahlia;
(4) Arabis mosaic virus;
(5) Plum pox virus;
(6) Tobacco ringspot virus

Article 6 Pre-export Requirements

(1) Orchard Management

1. Any registered orchards shall maintain their sanitation through effective monitoring and treatment of pests by technicians.

2. All the exporting orchards shall keep records regarding their monitoring and treatment of pests and shall provide the records to the AQSIQ as required.

(2) Controls over Specific Pests

1. With respect to Lobesia botrana and Rhagoletis cerasi, quarantine treatment shall be conducted in the course of export or import and the quarantine methods shall be approved by the AQSIQ in advance.

2. With respect to Lobesia botrana and Rhagoletis cerasi, effective monitoring shall be conducted in the season of cherry growth; and beginning from the second year of trading, both the China and Tajikistan parties shall jointly conduct the monitoring for three consecutive years.

3. Where the said two pests are not detected from three-year consecutive monitoring, four-year consecutive pre-inspection and entry quarantine, the quarantine treatment may be canceled.

(3) Processing and Package

1. Cherry processing, packaging, warehousing and transporting shall be duly supervised by the Tajikistan authorities.

2. During the course of processing and packaging, cherries shall be sorted to ensure that they are free from insect, mite, rotten fruit, malformed fruit, branch, leaf, root and soil.

3. The package materials shall be sanitary, unused, and compliant with Chinese phytosanitary requirements.

4. The packed cherries shall be kept in separate preservation that is free from any pest.

5. Each packing case shall be marked with the names of products, countries, and origins (orchards, package plants or their numbers) and the phrase of “export to the People's Republic of China” both in Chinese and English.

(4) Pre-export Inspection and Quarantine

1. Prior to the export to China, the Tajikistan authorities shall conduct inspection over each batch of cherries by sampling at the ratio of 2%; if none of phytosanitary problems occurs within two years, the sampling ratio may be reduced to 1% but not less than 600 fruits.

2. In the event of capture of the quarantine pests concerned, the batch of cherries concerned shall not be exported to China and, as the case maybe, the orchards and package plants involved shall be suspended.

(5) Phytosanitary Certification

1. The Tajikistan authorities shall issue phytosanitary certificates to the cherries of phytosanitary qualification; if quarantine is conducted before the export, the phytosanitary certificates shall be marked with the treatment methods and technical indicators.

2. The Tajikistan authorities shall provide the sample of the certificates to the AQSIQ prior to the trade activities so as for the AQSIQ to examine.

Article 7 Pre-inspection

The AQSIQ may, during the first four years of the trade, conduct pre-inspection at Tajikistan over the cherry export to China, and may decide whether to conduct the pre-inspection at Tajikistan for subsequent export years.

Article 8 Entry Inspection and Quarantine

(1) Certificate Verification

1. China inspection-quarantine agencies shall verify that the importing cherries are accompanied by AQSIQ-issued Quarantine License for Entry Animals & Plants.

2. China inspection-quarantine agencies shall verify that the phytosanitary certificates are compliant with the Item (5) of Article 6 herein.

(2) Entry Inspection and Quarantine

1. China inspection-quarantine agencies shall deal with the importing cherries in accordance with the phytosanitary manual.

2. China inspection-quarantine agencies shall review the pre-export quarantine treatment by the Tajikistan authorities over the aforesaid two pests concerned.

3. As regards the goods without pre-export quarantine over the two pests concerned, China inspection-quarantine agencies shall conduct the entry quarantine over the two pests.

Article 9 Disposal of Incompliance

1. If relevant certificates are not compliant with Item (1) of Article 8 herein, China inspection-quarantine agencies shall reject the declaration for inspection.

2. If the cherries originate in unauthorized orchards and package plants, the batch involved shall be prohibited from entry.

3. If pre-export quarantine is determined as null and void, the batch involved shall be subjected to entry quarantine.

4. If the package is not compliant with Item (3) of Article 6 herein, the batch involved shall be prohibited from entry.

5. If the quarantine pests concerned are detected, the batch involved shall be returned, destroyed, or quarantined.

6. Any incompliance with China national standard on food safety shall be subjected to China's Law and Regulations on Food Safety.

Article 10 Retrospective Review

1. If there is any change in the pests with Tajikistan cherries, the AQSIQ will conduct further assessment on risks and adjustment of quarantine measures.

2. The AQSIQ will conduct retrospective review over the implementation of these Requirements and may conduct corresponding revision thereto.
