GACC Announcement No.37, 2013 on Nissan North America, Inc. Duties Adjusted

In 2011, the Customs Tariff Commission of China decided to levy from December 15, 2011 two-year antidumping duties and anti-subsidy duties on some of automobile products made in the U.S.

In October 2012, the GACC hereto decided in its Announcement No. 49 of 2012 to levy antidumping and anti-subsidy security deposits on some of auto products made by Nissan North America, Inc. which was under a new-exporter review by the Ministry of Commerce of China (MOFCOM).

Now, based on the MOFCOM's review conclusion, the Customs Tariff Commission has decided to adjust the "double-anti" duty rates on Nissan North America, Inc. for the auto products involved.

Relevant Matters are hereby announced:

1. As of July 18, 2013, China Customs shall adopt the new rate of 3.6% for the antidumping duty and 0% for the anti-subsidy duty on the involved automobile products made by Nissan North America, Inc., and meanwhile the GACC Announcement No. 49 of 2012 shall cease to be effective.

2. Where the "double-anti" security deposits already paid exceed the antidumping duties and import-related consumption tax and value-added tax calculated at the rates herein, the importers may request the levying customs to return the excess amount within six months as from July 18, 2013.

3. With respect to the involved products made by other manufacturers, GACC Announcements No. 75 and 76 of 2011 shall still govern.
