GACC Announcement No.51, 2013 on Guangdong Processing-Trade Admin Approval Changes

In accordance with the State Council Notice (GuoHan [2013] no.9) on temporary adjustment of some administrative approvals, relevant matters are hereby announced with respect to the contract filing (alteration), non-local processing, and domestic sale by the processing trade enterprises based within Guangdong Province:
1. Processing Trade Contract Filing (Alteration)
(1) Guangdong-based operating enterprises may be exempt from submission of the Processing Trade Business Approval Certificate, the Online Supervised Enterprises’ Processing Trade Business Approval Certificate, and the contract alteration certificates whey they apply to the customs for the filing (alteration) of their processing trade contracts.
(2) When applying for the processing trade contract filing, the Guangdong-based operating enterprises shall submit to the customs their Certificate for Processing Capacity under Processing Trade issued by competent commerce administrations, unless otherwise specified.
(3) The enterprises aforesaid shall declare to the customs the conditions of raw materials, finished products and unit consumption that are subject to their processing trade contracts.
(4) Where any controlled goods are involved in the processing trade, the enterprises aforesaid shall, if being required, submit relevant approval documents at the time of their contract filing (alteration).
(5) The processing trade manuals declared by the operating enterprises have the period of validity not more than one year in principle; upon the customs approval, the validity may be extended, but shall not exceed two years. As regards the processing trade businesses of large equipment manufacturing such as airplanes and ships, the operators may apply for registering the manual validity as per the validity of their real export contracts.
2. Non-Local Processing Management
As regards a processing business to be done outside Guangdong, where both the operator and the processor are based in Guangdong, they may be exempt from the Processing Trade Business Approval Certificate, and other matters shall still be subject to China Customs Administrative Measures on Non-Local Processing Trade (GACC Decree No. 74); where one of the processor and the operator is not based in Guangdong, the GACC Decree No. 74 shall govern.
3. Domestic Sale under Processing Trade
The Guangdong-based operating enterprises, where applying for domestic sale of processing trade goods, may be exempt from submitting the Approval Certificate for Domestic Sale of Bonded Imported Materials under Processing Trade.
4. Other Matters
As regards the operator and the processor both based in Guangdong, when the operator enters the electronic data of the contract filing (alteration) and domestic-sale application into "the paper manual electronic system (enterprise end)", "the e-account system (enterprise end)" and "the domestic-sale management system (enterprise end)", it shall type "1111" into the "approval number" fields thereof.
