MOFCOM Announcement No.85, 2013 Ends Two-Anti Duties on USA Sedans & SUVs

On December 14, 2011, the Ministry of Commerce (MOFCOM) issued its annual announcement no.84 to levy antidumping and anti-subsidy duties on USA-made sedans and sports utility vehicles (SUV) of not-less-than-2.5-liter displacement for two years from December 15, 2011 to December 14, 2013.

On June 18, 2013, the MOFCOM issued its annual announcement no.43 declaring that the double-anti measures would expire on December 15, 2013 and interested Chinese parties may, 60 days before the expiry date, apply in writing to the MOFCOM for starting the expiry review.

Within the time limit, the MOFCOM received no request for the expiry review and decided not to initiate the review on its own. So, from December 15, 2013, the MOFCOM may terminate the antidumping and anti-subsidy duties on those USA sedans and SUVs aforesaid.
