MOFCOM Announcement No.11, 2014: Preliminary AD Ruling on Perchlorethylene from EU & USA

On May 31, 2013, China Ministry of Commerce (MOFCOM) announced starting antidumping (AD) probes into Perchlorethylene from the EU and the USA (the investigated products) under Chinese HS Code 29032300.

Based on its findings and China's Antidumping Regulations, the MOFCOM hereby makes its preliminary rulings as annexed hereto and announces relevant matters:

1. Preliminary Ruling
Within the investigated period for the case, the investigated products were dumped to China, and China's Perchlorethylene industry was materially injured, and there is a cause-effect relationship between the dumping and the material injury.

2. Security Deposit Levy
The MOFCOM has decided to conduct provisional antidumping measures in the form of security deposit.

As of February 18, 2014, the importers of the investigated products shall deliver the security deposit to China Customs as per the deposit ratios set forth herein.

(1) The investigated products: Perchlorethylene or Tetrachloroethylene (abbreviated as PCE) originating in the EU and/or the USA, usually as a colorless transparent liquid with ether-like odor.

Governing Chinese HS Code: 29032300

Usage: PCE is an important organochlorine product, widely used in industry as organic solvent, dry cleaner, desulfurizer, fabric finishing agent, metal detergent, fat extracter, organic synthesis and heat transfer media , as medical anthelmintic, and the intermediate for refrigerants HCFC-123, HCFC-124 and HFC-125.

(2) Deposit Ratios on the Companies Involved:

EU Companies:
Dow Deutschland Anlagengesellschaft mbH - 33%
SOLVAY BENVIC EUROPE-FRANCE S.A.S. - 33%
All Others - 33%

USA Companies:
Occidental Chemical Corporation - 76.2%
Axiall Corporation - 76.2%
The Dow Chemical Company – 76.2%
PPG Industries – 76.2%
All Others – 76.2%

3. Levy Method
The security deposit shall be calculated ad valorem in the formula: Deposit Amount = (customs-set duty-paid value × deposit ratio) × (1 + import VAT rate)

4. Comment
Within 10 days from the issue date of this Announcement, the interested parties may submit written comments attached with relevant evidences to the MOFCOM.
