MOFCOM Announcement No.17, 2014 on AD Probe on Optical Fiber Preform from Japan & USA

On January 22, 2014, the MOFCOM received a petition from Chinese industrial representatives for launching antidumping (AD) investigations into the Optical Fiber Preforms originating in Japan and the USA.

Based on its censorship and China antidumping regulations, the MOFCOM has decided to start the antidumping investigation from March 19, 2014, relevant matters as follow:

1. Investigated Periods

As from this Announcement issue date, the MOFCOM shall start to investigate the dumping of optical fiber preforms from Japan and the USA. The investigated period for dumping is set to be January 1, 2013 till December 31, 2013, and that of injury is set to be January 1, 2010 till December 31, 2013.

2. Investigated Product

The investigated products are Optical Fiber Preform or Fiber Preform originating in Japan and the USA.

Their usage is mainly for making optical fiber.

3. Registration of Legal Response

Regarding the dumping probe, any interested parties may within 20 days apply to MOFCOM’s Bureau for Fair Trade for participation into the legal response. The Dumping Investigation Response Registration Format is downloadable from MOFCOM website http://gpj.mofcom.gov.cn.

Regarding the injury probe, any interested parties may within 20 days apply to MOFCOM’s Bureau for Industry Injury Investigation for participation into the legal response. The Injury Investigation Application Form is downloadable from China Trade Remedy Info web http://www.cacs.gov.cn.

4. Rights of Interested Parties

The interested parties can download the non-confidential text of the antidumping petition from http://gpj.mofcom.gov.cn or refer to MOFCOM’s open information office (tel. 86-10-65197878).

If holding any objections to this investigation case, the interested parties can submit their opinions to the MOFCOM during the period of their registration.

5. Investigation Mode

The MOFCOM may investigate by means of questionnaire, sampling, hearing, and onsite inspection with the interested parties.

6. Questionnaire

(1) Dumping Questionnaire

The MOFCOM shall issue questionnaire to all companies involved within 10 workdays from the end of the registration period. The questionnaire, also downloadable from http://gpj.mofcom.gov.cn, contains companies’ organizational and operational status, the investigated products, export to mainland China, domestic sale, export to other countries/regions, production cost and fees, estimated dumping margins, and necessary checklists.

All the companies involved shall submit their completely answered questionnaire to the MOFCOM within 37 days from the questionnaire issue dates. Where the responders cannot submit on time, they shall request in writing for postponement of their submission 7 days before the deadline.

Where the responders fail to give feedback as required or hamper the MOFCOM’s investigations in any way, the MOFCOM may make its rulings based on any acquired facts and acquirable information.

(2) Industrial Injury Questionnaire

The notices on the injury questionnaire can be acquired on China Trade Remedy Information web (http://www.cacs.gov.cn/).

7. This investigation shall start from March 19, 2014 and end on or before March 19, 2015; in special case, it may extend to September 19, 2015.
