MOFCOM Announcement No.42, 2014 on Antidumping Probe in Hemodialysis Equipment from EU & Japan

On April 21, 2014, the MOFCOM received an application from Chinese industrial representatives for conducting antidumping (AD) investigation into the Hemodialysis Equipment originating in the EU and Japan.

Based on relevant examinations in accordance with China Antidumping Regulations, the MOFCOM hereby decides to institute the antidumping investigation on the hemodialysis equipment from the EU and Japan as from June 13, 2014, relevant matters as follow:

1. Institution and Investigated Periods
As from this Announcement issue date, the MOFCOM shall start the antidumping investigation on the hemodialysis equipment from the EU and Japan, and the investigated period for dumping is from January 1, 2013 through December 31, 2013 and the investigated period for injury is from January 1, 2011 through December 31, 2013.

2. Investigated Product
Importing Hemodialysis Equipment (or called Renal Dialysis Equipment or Artificial Kidneys) originating in the EU and Japan;

Products Description: a kind of medical equipment for hemodialysis, artificially imitating the filtration by human kidney; and in the case of extracorporeal circulation, removing excess nitrogen compounds, metabolites, or drug and other toxic substances, regulating water-electrolyte balance, and thus achieving a therapeutic function; as a highly integrated system, its basic structure consisting of three subsystems: extracorporeal blood-circulation system, liquid circulatory system and monitoring system.

3. Participation in Investigation
Any interested parties (whether organizations or individuals) may, within 20 days of this announcement, register with MOFCOM Bureau of Trade Remedy & Investigation for participation into this antidumping investigation. The participants shall, as per specified format, submit their information on export quantity, export value, product capacity, output, inventory, and construction and expansion plans.

4. Information Reference
The interested parties may refer to MOFCOM websites or information reading offices to download or access the non-confidential copy of Chinese antidumping application or related information.

5. Comment
The interested parties may deliver their comments on this investigation and related issues in writing to MOFCOM Bureau of Trade Remedy & Investigation within 20 days of this announcement.

6. Investigation Mode
The MOFCOM may investigate by means of questionnaire, sampling, hearing and field inspection.

The questionnaire may be issued to the parties involved within 10 workdays from the closing date of the participant registration as aforesaid.

The questionnaire may contain information about company structure and operations, the investigated export sales, domestic (regional) sales, operations and finance, and other related information, production costs and related expenses, estimated dumping margin and checklists, etc. content.

All parties involved shall return completed and accurate questionnaire within prescribed time limit.

7. Confidential Info Submission
The interested parties may request the MOFCOM to treat their submission in a confidential manner. If permitted, the interested parties shall also provide non-confidential summary which contains adequate meaningful information for good understanding; regarding the submission without confidential indication, the MOFCOM may treat them as public.

8. Noncooperation Results
The interested parties shall cooperate with MOFCOM investigation by giving truthful information. Otherwise, the MOFCOM may make ruling on the basis of acquired facts and information.

9. Investigation Period
This investigation shall start from June 13, 2014 and shall normally terminate on June 13, 2015, and under special circumstances may prolong till December 13, 2015.
