GACC Announcement No.44, 2014 on Container Same-Ship Transport & Chinese International Navigation Ship Carrying Customs-Transferred Goods

To promote the construction of Shanghai International Shipping Center and Pilot Free Trade Zone, in accordance with Announcement No.55 of 2013 by the Ministry of Transport, the GACC has decided to adjust its Announcement on Pilot Work Concerning Inbound/Outbound Container Transport by the Same Ship and Carry of Transferred-Across-Customs Goods by Chinese-Nationality International Navigation Ships (originally as GACC Announcement No.3 of 2005), relevant matters as follow:

1. The port-based enterprises and shipping companies intending to undertake the some-ship transport of containers shall refer to customs supervision requirements on means of transport and register with local customs in charge.

2. The Chinese-nationality international navigation ships intending to undertake the carry of transferred-across-customs container goods shall refer to GACC Decree No.121 and register with local customs in charge and shall provide their registry numbers in “ship registry” remark of Customs Supervision Book On Entry & Exit Of International Navigation Ships.

3. As regards any non-Chinese international navigation ship that is wholly or partially owned by a Chinese-invested shipping company, where intending to undertake the carry of transferred-across-customs container goods, its owner shall register with local customs in charge by submitting the Certificate on Coastal Carry Registration for Chinese-Invested Non-Chinese-Nationality International Navigation Ships in accordance with GACC Decree No.121.

4. The port-based enterprises shall undertake differentiated storage with distinctive marks for inbound and outbound container goods; the wharfs involved shall be put in an enclosed management and be connected to customs computer networks for data transmission.

5. Any non-Chinese international navigation ship that is wholly or partially owned by a Chinese-invested shipping company, where engaged in the carry of transferred-across-customs container goods, shall be restricted to Shanghai port for international transshipment between Shanghai and other Chinese externally-opened ports. And the Chinese-invested shipping companies shall not sublease such ships registered with China customs.

6. The containers carried by the same ships shall be compliant with the standards set forth in GACC Decree No.110 (customs supervision measures on supervised containers and container-type cars).

7. This Announcement shall enter into force upon its issuance along with simultaneous repeal of GACC Announcement No.3 of 2005.
