NDRC-MOFCOM Announcement No.12, 2014 (on Agricultural Import Tariff Quota Re-Allocation)

In accordance with China's Provisional Measures on Tariff Quota for Import Agricultural Products, we hereby make and promulgate the Announcement On 2014 Re-Allocation Of Tariff Quota For Import Agricultural Products.

Announcement On 2014 Re-Allocation Of Tariff Quota For Import Agricultural Products


In accordance with relevant measures and rules set forth in MOFCOM-NDRC Decree No.4 of 2003, NDRC Announcement No. 39 of 2013, and MOFCOM Announcement No.68 of 2013, hereby announced are the matters concerning the re-allocation in 2014 of tariff quota for importing agricultural products:

1. An end user of 2014 tariff quota for importing wheat, corn, rice, sugar and cotton, where it has no contract signed on its total tariff quota or where its import cannot be shipped from the port of origin by the yearend, shall return the unconsumed or inconsumable portion of its tariff quota to local provincial departments under the NDRC and the MOFCOM by September 15, 2014. The NDRC and the MOFCOM will re-allocate the returned tariff quota. If the end user fails to return by September 15 or to fully consume by the yearend, its tariff quota will be accordingly deducted by the NDRC and the MOFCOM from next-year allocation of the tariff quota.

2. An end user having obtained the 2014 tariff quota for the products listed above and having fully consumed them (to be evidenced by import declaration forms) and a new user that is compliant with the quota application conditions may apply in writing to local provincial departments under the NDRC and the MOFCOM for re-allocation of the import tariff quota.

3. The applicants shall, during September 1-15, submit their application for the re-allocation in the form as annexed hereto.

4. Local provincial departments herein will, after their preliminary examination, deliver from September 1 the qualified applications to dedicated import-tariff-quota computer management system and will, by September 20, submit the applications arranged in time order to the NDRC and the MOFCOM.

5. The NDRC and the MOFCOM will re-allocate the returned quotas in online declaration order and will, before October 1, 2014, notify the end users of the re-allocation results.

If the number of qualified applications is less than the re-allocation quantity, each application will be satisfied; if the number of qualified applications is more than the re-allocation quantity, the re-allocation will be conducted in the way of “first come, first served”.

6. Other issues as the validity of the re-allocated quotas may resort to relevant measures and rules set forth in MOFCOM-NDRC Decree No.4 of 2003, NDRC Announcement No. 39 of 2013, and MOFCOM Announcement No.68 of 2013.

7. The re-allocation of tariff quotas for importing wheat, corn, rice and cotton will be conducted by the NDRC, the MOFCOM along with provincial departments under the NDRC; such quota re-allocation for sugar import will be conducted by the MOFCOM and provincial departments of commerce.
