GACC Decree No.224 on Revising Import Origin Measures under China-Chile FTA

On September 30, 2014, the General Administration of Customs of China (GACC) adopted GACC Decision for Revising Import Goods Origin Measures under China-Chile Free Trade Agreement, which is hereby promulgated and shall enter into force on October 1, 2014.

GACC Decision for Revising Import Goods Origin Measures under China-Chile Free Trade Agreement (FTA)

To coordinate with revising the product-specific origin rules under China-Chile FTA, the GACC has decided to make revisions to China Customs Administrative Measures on Import Goods Origin under China-Chile Free Trade Agreement (GACC Decrees No.151 and No.198) as follow:

1. The item (3), the first paragraph, Article 3 in these Measures is split into two items as below:

(1) Revised into "produced within Chile only or within both China and Chile, using non-native materials, belonging to the scope set in Annex 1 of these Measures, and compliant with the product-specific origin criteria set forth in Article 6 of these Measures";

(2) Added with "produced within Chile only or within both China and Chile, using non-native materials, outside the scope set in Annex 1 of these Measures, and compliant with the regional value component standard set forth in Article 7 of these Measures" as the item (4) therein;

Additionally, added with "any change in Annex 1-listed product-specific origin criteria will be announced otherwise by the GACC" as the second paragraph of Article 3.

2. In the item (2), the first paragraph of the Article 18, "the bills of lading issued within Chile" is revised into "documents of through transit from Chile to China".

3. The third paragraph of Article 18 is revised into "where the goods are transited from Chile to China via other countries/regions, the import consignee also shall submit certifying documents issued by the customs of other countries/regions or submit other certifying documents recognized by China Customs".

This Decision shall enter into force on October 1, 2014.

China Customs Administrative Measures on Import Goods Origin under China-Chile Free Trade Agreement shall be revised as per this Decision.
