MOFCOM Announcement No.6, 2015 (on AD Interim Review for Pyridine from India )

On November 20, 2013, the Ministry of Commerce (MOFCOM) issued annual Announcement No.73 deciding to impose antidumping (AD) duties on pyridines from India and Japan.

On December 12, 2014, China's domestic industrial representatives made a repetition to the MOFCOM for an antidumping interim review on the pyridine made by India's Jubilant Life Science Limited by claiming that company's pyridines had increased in dumping margin.

On December 16, 2014, Jubilant party applied to the MOFCOM for the antidumping interim review by claiming its normal value, export price and dumping margin had all been materially changed and therefore the antidumping duties are unnecessary.

Upon its investigation, the MOFCOM has decided to start the interim review in dumping and dumping margin of the import pyridines made by Jubilant Life Science Limited from India. Relevant matters are hereby announced:

1. Product Scope
The involved product shall be the import pyridines made by Jubilant Life Science Limited from India.

Physical-Chemical Characteristics: Pyridine is a six-membered heterocyclic compound containing one nitrogen heteroatom, usually colorless or slightly yellow liquid with a strong pungent odor, toxic flammable, soluble in water, alcohol, ether, etc., usable as raw material or solvent for pharmaceuticals, chemicals, pesticides, etc.

2. Review Period and Scope
(1) Review period is January 1, 2014 – December 31, 2014.
(2) Review scope is the antidumping duty rate on the import pyridines made by Jubilant Life Science Limited from India.

3. Review Procedure

(1) Interested Parties' Comment
Any interested parties may, within 20 days upon the issue of this Announcement, give written comments on the interim review along with corresponding evidences.

(2) Questionnaire
For the purpose of investigation, The MOFCOM will send questionnaire forms to the interested parties, who should give written answers within 37 days upon receipt.

(3) Hearing
The interested parties may request in writing the MOFCOM to hold relevant hearings and the MOFCOM also may initiatively hold the hearings.

(4) Field Inspection
The MOFCOM may dispatch personnel to conduct field inspections in any countries involved; the interested parties should in advance state their consent to the field inspections in their submitted documents.

4. Non-Cooperation Consequences
During the MOFCOM's investigation, the interested parties should give true information and materials. If they give false information or materials or fail to act in due time or hinder the investigation in any other ways, the MOFCOM may make rulings as per acquired facts and acquirable information.
