GACC Announcement No. 34, 2015 (on "Goods Import Certificate" Matters)

In order to regulate the management of the "Goods Import Certificate", relevant matters are hereby announced:

1. This Goods Import Certificate refers to a certifying document issued by the Customs at the request of a goods importer to prove complete release of importing goods.

Under any of the following circumstances, the importer may, upon complete release of importing goods, apply to the Customs for the issue of this Certificate:

(1) Import of a whole finished automobile or motorcycle;
(2) Import of any goods in definite need of this Certificate as regulated;
(3) Import of the goods subjected to this Certificate by any international convention that China has joined or concluded;
(4) Import of the goods to which the Customs has consented to issue this Certificate

Under any of the following circumstances, the Customs may not issue this Certificate:

(1) Temporary entry of goods (including finished automobiles or motorcycles) for repair or under processing trade or leasing trade, which will re-exit later;
(2) Re-entry of exported goods;
(3) Bonded goods from abroad into special Customs-control areas or bonded supervision premises;
(4) Bonded goods transferred between special Customs-control areas or bonded supervision premises

2. Regarding finished automobiles or motorcycles, the importer may, after finishing declaration formalities, apply to the Customs for this Certificate issuance by providing supplemental automobile or motorcycle data into declaration pre-entry system.

Automobile specific data include HS code, commodity name, specifications, power type, engine number/motor number, displacement/motor power, vehicle identification number, color, country of origin, date of manufacture; motorcycle specific data include HS code, commodity name, specifications, engine number, displacement, vehicle identification number, color, country of origin, date of manufacture.

3. Upon complete release of the import in compliance with the Article 1 terms, the Customs may issue this Certificate as requested by the importer.

One finished automobile or motorcycle shall only be provided with one Certificate herein as "one vehicle with one Certificate"; other import goods shall refer to "one batch with one Certificate" meaning that one declaration form is corresponding to one Certificate herein.

4. The importer shall, within three years upon complete release of its import, apply to the Customs for issue of this Certificate. Where an issued Certificate has data errors arising from declaration data errors, the importer shall, within three years upon the issue, request the Customs to re-issue this Certificate. Where the automobile/motorcycle Certificate is lost, the vehicle owner shall, within three years upon the issue, request the Customs to re-issue one; regarding other kinds of goods, the re-issue shall not be permitted.

5. Where the importing automobile/motorcycle Certificate is lost, the vehicle owner may request the Customs to re-issue one by submitting the following materials:

(1) Written application providing the legal sources of the vehicle and the Certificate, and loss time, place and course; or "power of attorney" if any;
(2) Relevant import documents (copies), invoice, trade contract or other certificates of procurement;
(3) Proof of loss issued by public security bureaus;
(4) Proof of loss publicized by provincial newspaper;
(5) Business license, organization code certificate (copy), ID cards, power of attorney;
(6) others required by the Customs

6. Where the import goods are returned or exported, the importer shall return this Certificate to the issuing Customs for cancellation.

7. Upon its issue, this Certificate shall not be altered on its face; where alteration is necessary, the importer shall apply for re-issue of this Certificate as per the Article 4 stipulations aforesaid.

8. The descriptions on this Certificate shall be consistent with the status information recorded by the Customs upon complete release of import goods concerned. Where the goods have changes to be inconsistent with this Certificate, the Customs shall reject re-issue or alteration of this Certificate.

9. This Certificate for finished automobiles or motorcycles shall be only used for the automobile or motorcycle license-number registrations with public security and traffic administrations, rather than other purposes including mortgage or administrative proof.

10. The applicable commodity scope and regulatory requirement under this Certificate shall still be subject to the Announcement No. 44 of 2005 jointly made by GACC, NDRC and MOFCOM.
