GACC Announcement No.52, 2015 (on China-EU "AEO" Mutual Recognition)

In May 2014, China Customs and EU Customs jointly signed a written Decision on Arrangement for Mutual Recognition of China Customs' Enterprise Classification System and EU Customs' Authorized Economic Operator System (hereinafter referred to as "Mutual Recognition Arrangement").

China Customs has been implementing its latest Measures on Enterprise Credit Management (as in GACC Decree No.225) since 1 December 2014. China Customs and EU Customs have jointly revised their bilateral Mutual Recognition Arrangement and decided to put it into force on 1 November 2015. Relevant matters are hereby announced:

1. EU Customs will recognize the high-grade enterprises certified by China Customs as China's "Authorized Economic Operators" (AEO for short), while China Customs will recognize the secure AEO enterprises (including AEOC and AEOS) certified by EU Customs.

2. China Customs and EU Customs will mutually provide the following clearance facilitations for AEOs from the other in cargo import and export: reduction of inspections or control-related risk assessments; recognition of secure trade partnership; priority in cargo clearance; trade sustainability securing mechanism.

3. Chinese AEO enterprises will be entitled to facilitating measures provided by EU Customs for their exports to and imports from EU countries. In their export and import, Chinese AEOs shall inform their EU trade partners of their certification codes (CN + 10-digit enterprise code registered with China Customs); then EU importers/exporters will declare Chinese AEO information to EU Customs for the Customs to check with relevant AEO information pre-provided by China Customs and, where mutually consistent, facilitations in clearance will automatically apply to Chinese AEOs.

4. EU AEO enterprises will be entitled to facilitating measures provided by China Customs for their exports to and imports from China. Chinese importers or exporters, in their declaration of EU AEO information to China Customs, shall provide EU AEO enterprise codes in the "Remarks" column of their Declaration forms by writing: "AEO" (in English half-width) + "<" (in English half-width) + "EU EORI code" + ">" (in English half-width); for example, if an EU EORI code is FR123456789012345, the required to provide will be "AEO<FR123456789012345>". Then China Customs will check the codes with relevant AEO information pre-provided by EU Customs and, where mutually consistent, facilitations in clearance will automatically apply to EU AEOs.
