GACC Announcement No.9, 2017 on Foreign-Invested Enterprise Registration Matters

Recently, the Ministry of Commerce (MOFCOM) has issued the “Administrative Measures on Registration of Foreign-Invested Enterprise Setup and Alteration” (in MOFCOM Decree No. 3 of 2016). The Admin Measures provide: regarding the setup and alteration of a foreign-invested enterprise which is outside the special measures on foreign investment admission, relevant approval formalities shall be changed into registration formalities; after the registration is done, the foreign-invested enterprise may claim written acknowledgement for its setup or alteration registration from the registering agency.

The following are the matters with corresponding Customs registration for foreign-invested enterprises:

1. A foreign-invested enterprise to register with the Customs as an exporter/importer shall present and submit required documents as in GACC Decree No. 221, including any of these below:

(1) Foreign-Trade Operator Registration Form (with copy);

(2) Foreign-Invested Enterprise Approval Certificate (with copy);

(3) Acknowledgement of Foreign-Invested Enterprise Setup or Alteration Registration (with copy)

2. The enterprises based in Hong Kong SAR, Macau SAR, or Taiwan region may refer to the above regulations for the registration herein.

This Announcement shall enter into force upon its issuance.
