3. The Temporarily-permitted Import & Export Goods under the ATA Carnet
(1) For temporarily-permitted import and export goods under the ATA Carnet, is limited to the goods under the Customs Convention on the ATA Carnet for the Temporary Admission of Goods (ATA Convention) joined by our government and the relevant exhibition, fair, conference and so on, the license-holder does not need to fill in the declaration form for the import and export goods and provide the guarantee of the import duty with ATA carnet. For those import-restricted goods under the ATA carnet, the ratification and examination procedures must be gone through. In terms of the temporarily-permitted exported goods that belongs to the export-restricted goods by the State or that export duty need to be paid for, the overall guarantee is provided by China's International Chamber of Commerce to the General Administration of Customs. The Customs can handle the relevant procedures by the guarantee provided by the party concerned for the temporarily-imported goods without the ATA carnet.

(2) For temporarily-permitted import goods under the ATA carnet that belongs to other import-restricted scope except the import license, quota, such as for the restricted measures based on the consideration of public ethics and order, public security, public health and care, animals & plants quarantine, endangered wild animals & plants protection or intellectual property rights, the license-holder must handle the relevant procedures according to the regulations. In terms of the temporary import and export by means of lease and rental for the purpose of production, architecture and transportation, the exemption of duty is only partial.
