Announcement of the General Administration of Customs No.9, 2010 on Imposing Tem

According to the Anti-dumping Regulations of the People's Republic of China, the Ministry of Commerce decides to impose the temporary anti-dumping measures on imports of terephthalic acid originated from the Korea and Thailand from February 3, 2010 onwards. The matters are announced as follows:

1. Starting from February 3, 2010, apart from levying tariff and VAT in accordance with current regulations, the terephthalic acid (HS code: 29173611 and 29173619) imported from South Korea and Thailand, also needs levying anti-dumping deposit and corresponding value-added tax (VAT) deposit based on the following formula and the deposit rate listed in the appendix of this announcement.

The formula of totaling anti-dumping deposit and VAT deposit:
Total deposit= (duty-paid price * anti-dumping deposit rate) * (1+ VAT rate)

2. Corporations which declare terephthalic acid imports should submit the Certificate of Origin. If the origin is South Korea or Thailand, the invoice of original manufacturer is needed separately. To those corporations which could not provide the Certificate of Origin, besides, the customs inspection still could not confirm that the origin is other countries except for South Korea or Thailand. In this case, the customs should levy the deposit based on the highest anti-dumping deposit rate listed in the appendix. Moreover, to some corporations, which could confirm that the commodities are of South Korea or Thailand origin, but the invoice could not be provided and the original manufacturer still could not be identified through other legal and valid documents, the customs would levy deposit according to the deposit rate applied to other corporations of corresponding countries (regions) listed in the appendix.

3. Referring to the maters about how to levy the anti-dumping deposit of terephthalic acid bonded imports in processing trade from South Korea or Thailand, the customs would take proper measures in accordance with the regulations of the announcement of the General Administration of Customs No. 9, 2001 and the order of the General Administration of Customs No. 111.

4. The measures about how to conduct levied anti-dumping and VAT deposit would be announced separately in accordance with the final determination.

It is hereby announced.
