Administrative license for foreign-funded enterprises further simplified and sta

China??s Ministry of Commerce recently published the Notice on Further Simplifying and Regulating the Administrative License for Foreign-funded enterprises.



According to the notice, the competent provincial department of commerce are entrusted to examine and approve the non-essential alterations (including change of enterprise names and the like) of a foreign-funded enterprise authorized by, the Ministry of Commerce, to issue approval certificates, and to report to the Ministry of Commerce for archival filing.



For a foreign-funded enterprise authorized by the Ministry of Commerce belonging to the category below the limit (USD 100 million for a foreign-funded enterprise in the encouraged or permitted category in the Catalogue of Industries for Guiding Foreign Investment, and USD 50 million for one in a restricted category, hereinafter referred to as the ??limit??), the competent provincial department of commerce shall be responsible for examination and approval of its any alteration(investment enterprises, those involving special provisions, special industrial policies and national macro-control industries are excluded), and to report to the Ministry of Commerce for archival filing.
