[Imports Management ] The Interpretation of Administrative Measure of Manifest b

The Administrative Measures of the Customs of the People’s Republic of China for Manifests of Inward and Outward Means of Transport ( hereinafter referred to as Measure ) has been approved by General Administration of Customs in March 10, 2008 and promulgates to the public officially. The measures will be implemented in January 1, 2009 and the Administrative Measures of the Customs of the People’s Republic of China for Transmission of the Electronic Data of Manifests ( hereinafter referred to as the former administrative measure) shall be abolished simultaneously. The implementation of Measures will play an important role to the management on manifests of inward and outward means of transport.
 
(1)   Background of this legislation
 
Ⅰ、The establishment of Measure is the requirement of international logistics development and the unity of law enforcement by customs
 
Ⅱ、The establishment of Measure is the requirement of business reform and development for customs
 
Ⅲ、 The establishment of Measure is for the convenience and facility of international trade. 
 
(2)The issues worth you attention
 
Ⅰ、The style and structure
Compared with the former administrative measures, this Measure makes great changes: It adds the content of manifest management and manifest alteration of railway train and road vehicle and makes a detail provision on the advanced transmission time limit of inward and outward manifest to customs. For a more accurate interpretation, it changes name to Administrative Measures of the Customs of the People’s Republic of China for Manifests of Inward and Outward Means of Transport.
 
Ⅱ、Interpretation of the basic conception of applicable scope and manifest
The former measure is only applicable to the management of electronic data transmission for ocean shipping and aviation manifest. This Measure expand its applicable scope to the management on the manifest of inward and outward vessel, aircraft, railway train and road vehicle.
 
Ⅲ、The main body of transmission for electronic data of manifest.
The transmission of electronic data of manifest includes two parts: the electronic data of manifest and relevant electronic data of manifest, so the main bodies of electronic data manifest are formed by two parts accordingly: the person in charge of manifest transmission and the person in charge of relevant data transmission. The two bodies shall transmit manifest and relevant electronic data to customs in the stipulated time.
 
Ⅳ、The time limitation for electronic data transmission of manifest
The time limitation for electronic data transmission of manifest are stipulated for the following 4 reasons: (1) reference of other time limitation of manifest stipulated by relevant provision (2) requirement of working process in customs (3) according to different transmission capability in different company (4) requirement of data exchange between different customs in the world.
 
Ⅴ、The electronic data alteration of manifest
The former administrative measure only takes little changes on manifest alteration while this measures makes special stipulation on the manifest alteration including free alteration and the application for alteration as well as the alteration after punishment.
 
Ⅵ、The electronic data format of manifest.
As the supported measures of this Measure, the customs has developed a management system for the manifest of inward and outward means of transport. The format will be announced recently and implemented simultaneity.
