Anti-dumping Announcement of General Administration of Customs on Phenol

According to Regulations of the People s Republic of China on Anti Dumping, the tariff association of the State Council decided to levy anti-dumping tariffs on phenol originated from Japan, Korea, America and Taiwan since February 1, 2009. Recently, the Chang Chun Plastics Co., Ltd in Taiwan applies to implement anti-dumping tariff on newly exported commodities solely, so the Ministry of Commerce decides to take re-investigation on newly exporters for the anti-dumping measure on import phenol originated from this company. The relevant issues are formulated as follows:

(1)、Since March 2, 2009, the declared import phenol originated from Chang Chun Plastics Co., Ltd in Taiwan district, except be levied for tariffs and import linkage VAT, also be levied for anti-dumping deposit cash with the anti-dumping rate of 19% and import linkage VAT deposit cash which are applicable to other Taiwan companies stipulated in No.3 announcement of General Administration of Customs in 2009. No anti-dumping tariff will be levied before the Ministry of commerce makes a review

The calculation formula for the summation of deposit cash of anti-dumping and import linkage VAT is as follows:

Total sum of deposit cash=(dutiable price of customs ×levy ratio of anti-dumping deposit cash) ×(1+rate of import linkage VAT)

(2) The declared import phenol from other manufacturers shall still follow the No.3 announcement of General Administration of Customs in 2009.

(3)The General Administration of Customs shall deal with the levied cash deposit of anti-dumping and import linkage VAT according to the separate announcement after the review.
