Article 1 (Purpose and Basis)
For the purpose of strengthening the administration of the
standardization of the graphic signs of public information
in this Municipality, raising the degree of urban civilization
and level of administration, and for the convenience of people's
living, these Procedures are formulated in accordance with
the provisions of the "Law of the People's Republic of
China on Standardization" and "Regulations on the
Implementation of Law of the People's Republic of China on
Standardization", and other laws and regulations and
in the light of the actual circumstances of this Municipality.
Article 2 (Application Scope)
These Procedures apply to the formulation, manufacture, sales
and installation of graphic signs of public information in
the public places within the administrative areas of this
Municipality (hereinafter referred to as graphic signs of
public information) and the corresponding supervision and
administration.
Article 3 (Definition)
The graphic signs of public information mentioned in these
Procedures refer to the signs that indicate the use and location
of the public places and public facilities, remind and guide
people's behavior in the form of graphs, colors and necessary
words and letters or their combinations.
The formulation of the graphic signs of public information
mentioned in these Procedures refers to the determination
of the graphic symbol used in the graphic signs of public
information, including the collection of the needed information
and the designing and testing of the scheme of the graphic
symbol used in the signs according to specific procedures.
The manufacture of the graphic signs of public information
mentioned in these Procedures refers to the designing and
making of the graphic signs of public information according
to the graphic symbols and colors provided in the national,
trade and local standards.
Article 4 (Administrative Department)
The Shanghai Municipal Quality and Technical Supervision
Bureau (hereinafter referred to as the Municipal Quality and
Technical Supervision Bureau) is the competent administrative
department of the standardization of graphic signs of public
information in this Municipality, and shall be responsible
for the administration of the standardization of graphic signs
of public information in this Municipality.
The Quality and Technical Supervision Bureau of every district/county
shall be responsible for the routine administration of the
standardization of graphic signs of public information in
its own administrative area.
Article 5 (Duties of Relevant Departments)
The administrative departments of urban traffic, civil aviation,
railways, construction, urban infrastructure, tourism, commerce,
culture, broadcasting, film and television, public health,
public security, fire fighting, city appearance and environmental
sanitation, and greening, etc. shall, according to its own
duty, organize the implementation of the standard of the graphic
signs of public information within its own system or trade,
and accept the guidance from the quality and technical supervision
departments.
Article 6 (Procedures and Requirements of the Formulation
of Signs)
The graphic signs of public information shall be formulated
according to relevant national, trade and local standards
of the graphic symbols for signs.
The designing of graphic signs shall be normal, accurate,
terse and eye-catching, and the Chinese description shall
meet the relevant national requirements on the general use
of language and words.
Article 7 (Formulation of Sign Standard)
The Municipal Quality and Technical Supervision Bureau shall
formulate the local standard of graphic signs of public information
that need to be widely used in public places in this Municipality,
but the State or trade has not yet formulated the standard.
The unit or individual person may make suggestions on the
formulation of the local standard to the Municipal Quality
and Technical Supervision Bureau.
Article 8 (Manufacture and Sales of Signs)
If the national, trade or local standard has provided the
graphic symbols or colors of the graphic signs of public information,
the manufacturer of the graphic signs of public information
shall manufacture the graphic signs of public information
according to the provisions of the national, or trade or local
standard.
The manufacture and sales of the graphic signs of public
information that violate the provisions of the preceding Clause
are not allowed.
Article 9 (Installation of Signs)
The areas and facilities in public places that involve the
safety of person and property, and the basic need of the citizens
shall install graphic signs of public information.
In the public places other than the public places provided
in the preceding Clause, the managing and user unit may install
appropriate graphic signs of public information according
to needs.
The installation of graphic signs of public information shall
comply with the principle relevant to the installation of
graphic signs and the provisions on the required national
or trade standards. The detailed installation schemes for
each trade shall be separately formulated by the Municipal
Quality and Technical Supervision Bureau jointly with the
respective relevant competent administrative department. The
managing and user unit of the public places or the relevant
organizations shall organize the implementation.
Article 10 (Installation of Signs in the Project of Urban
Infrastructure)
For the project of urban infrastructure within the scope
of the provision of Clause 1 of Article 9 in these Procedures,
the construction unit shall include the installation of graphic
signs of public information into the designing of the engineering
project. The construction unit shall, when organizing the
relevant units of designing, construction and engineering
supervision for the acceptance inspection upon completion,
list the situation of the standardization of installation
of graphic signs of public information as an item of the acceptance
inspection.
In the project of urban infrastructure provided in the preceding
clause, the space reserved for the graphic sign of public
information shall have the priority to the commercial advertising
facilities. In case of the installation of commercial advertisement,
the practical effects of the graphic signs of public information
shall not be affected.
Article 11 (Self-Formulation, Self-Manufacture and Self-Installation
of Signs)
In case that there is no relevant national, trade or local
standard, but the managing and user units of the public places
need to install graphic signs of public information, they
may formulate, manufacture and install graphic signs of public
information by themselves.
Article 12 (Maintenance of Signs)
The units that install graphic signs of public information
shall do periodical inspection and maintenance to the graphic
signs of public information in the areas of their management.
In case of damaging or falling off, etc., they shall in time
repair or replace the signs to keep the graphic signs of public
information in good condition, clean and tidy.
Article 13 (Inquiry about Standards)
The Municipal Quality and Technical Supervision Bureau shall
establish an inquiry system of the standards of graphic signs
of public information, and provide inquiry service of standards
of graphic signs of public information for units and individual
persons.
Article 14 (Punishment Imposed on Wrongful Act)
In case of manufacturing or selling graphic signs of public
information that do not comply with the compulsory provisions
of the national, trade or local standards, the quality and
technical supervision departments shall order the violator
to rectify within a time limit. In case of no rectification
when the time limit is due, the violator shall be punished
according to Article 33 in the "Regulations of the People's
Republic of China on the Implementation of Standardization"
In case of installing the graphic signs of public information
that do not comply with the compulsory provisions of the national,
trade or local standards, or the installation of graphic signs
of public information that does not comply with the compulsory
national, trade or local standards, the relevant competent
administrative departments shall order the violator to rectify,
or impose a punishment according to the provisions of relevant
laws, rules and regulations. In case of finding the above-mentioned
wrongful acts, the quality and technical supervision departments
shall apply to the relevant competent administrative department
for the timely implementation of supervision and administration.
Article 15 (Catalogue of Implementation of Standards)
Standards for the formulation, manufacture, sales and installation
of graphic signs of public information shall be performed
according to the "Catalogue of Implementation of Standards
of Graphic Signs of Public Information" attached to these
Procedures.
The Municipal Quality and Technical Supervision Bureau may,
according to the situation relevant to the formulation of
standards of graphic signs of public information made by the
State, the trade and this Municipality, make some additions
and adjustments to the items listed in the "Catalogue
of the Implementation of Standards of Graphic Signs of Public
Information", and publish to the society after reporting
it to the Municipal People's Government for approval and thereby
getting the approval.
Article 16 (Implementation Date)
These Procedures shall become effective on April 1, 2003.
