The management regulations for usage of certificate and mark

1 General rules
The regulation stipulates the requirements for the certificate holder to use the management system certificates issued by CQC and the marks of CQC organizations; made clear the rights and responsibilities of using the certificates and marks.
2 Management regulations
2.1 Management regulations for the use of the certificates
2.1.1 The rights and obligation for the organizations to use certificate.
a) Be entitled to use the certificate correctly in the term of validity.
b) The certificate can be showed in the document, website, site for certification activities, sale site, advertisement and propaganda material; but the management system certificate and the related characters or mark can not be used to misguide the public into thinking that the other management system, product or service which is out of the certificate scope gets the certification. The prestige of CQC shall not be harmed while propagandizing the certification result.
c) Within the field and service scope covered by the effective management system certificate, the organization who get the certificate may show the related information of certificate in the document, website, site for certification activities, sale site, advertisement and propaganda material or advertisements of commercial activities and the outside-packing of the product according to the following ways, and this packing shall be ensured not be able to arrive in the final user. For example: " This organization (or enterprise) has gotten through the **** management system certification of China Quality Certification Center, the certificate number is xxxxx ".
****: means the name of the related management system certification of the organization who get the certificate, such as, the Quality or ISO9001, environment or ISO14001, food safety or HACCP, occupational health and safety or OHSMS and so on.
u xxxxx： Means the serial number of management system certificate of the organization that gets the certificate.
d) It may appeal to CQC if the use of the certificate is hindered by other organization or person.
e) In order to avoid losing or damaging the certificates, the organization shall properly take care of them. If the certificate is lost or damaged, the organization may apply to reissue.
f) To assure the management system within the scope of the certificate operates stably.
g) To establish the regulations for the use and management of the certificate and truthfully record and put on files about the use of the certificates.
h) When the quality management system has great change, the organization shall report to the certification body and accept the investigation or the surveillance audit. The certificate can not be used before the investigation, or if the organization can not get through the surveillance audit.
i) The certificate can not be forged, altered, lent, hired, demised, resold, partially exhibited or partially copied.
j) To obtain or maintain the certificate, the organization shall pay for the certification on time.
k) If the certificate is suspended, withdrawn or cancelled by CQC, the organization shall return the certificate to CQC according to the request of CQC, simultaneously, it shall stop showing the certificate in the document, website, site for certification activities, advertisement and propaganda material, and shall also stop taking the related information into commercial activity.
2.1.2 The main form of misuse / abuse certificate
a) Use certificate by wrong way or misuse it in the system beyond the certificate scope.
b) The wrong propaganda of the certificate in any material, make use of the management system certificate and the related characters or mark to misguide the public into thinking that the other management system, product or service which is out of the certificate scope gets the certification; harms the prestige of CQC while propagandizing certification result.
c) Use the certificate without permission.
d) Arbitrarily modify the certificate content without the approval of CQC.
e) The certificate is forged, altered, lent, hired, demised, resold, partially exhibited or partially copied.
2.1.3 The corrective measure CQC adopts when the certificate is misused / abused
a) Sends out “processing notice of misuse / abuse certificate” to the organization which misuses / abuses the certificate, and orders it to correct.
b) According to the regulation of suspension and withdrawal in the published document, suspends or withdraws the certificate.
c) If necessary, investigate the organization’s legal responsibility according to the related law.
2.1.4 The term of validity of management system certificate and the IQNet certificate is three years, still the organization must accept surveillance audit of CQC every year. The certificate can not be used unless it conforms to the requirements of CQC and obtained《Notice on Conformity for Surveillance Audit》 issued by CQC. The copy piece of certificate does not have the legal effect.
2.1.5 If the certificate is lost because of improperly keeping, the organization may apply to reissue, simultaneously; it shall also report the loss of the certificate on related magazine or website of CQC.
2.2 The management regulations for the use of certification mark
2.2.1 The procedure for use of the certification mark
a) The mark of certified organization includes CQC mark of certified organization, the combination mark of CQC mark of certified organization and the CNAS approval mark, the combination mark of CQC and IQNet marks of certified organization, the combination mark of CQC and IQNet marks of certified organization and CNAS approval mark.
b) The organization may voluntarily choose CQC mark when it obtaining the CQC management system certificate;
c) It can not choose the combination mark of CQC mark and CNAS approval mark unless it has obtained the CQC management system certificate added with the CNAS approval mark.
d) Certified organization having obtained the IQNet management system certificate issued by CQC, may voluntarily choose the combination mark of the CQC and IQNet mark, or the combination mark of CQC mark, IQNet mark and CNAS approval mark.
e) Having obtained the CQC management system certificate and / or the IQNet certificate, then Certified organization may voluntarily download the mark from the CQC website, and use the mark according to the regulation.
f) The organization which gets the certificate may conditionally use the mark in the related situation within the field and the operation scope covered by the management system certificate. For example, it may be showed in the related document, the stationery, the work place, sale place or used on the publication, but can not be added to the product. It cannot be labeled on the large package for product transportation unless there is an indication, “the organization or enterprise has gotten through the **** management system certification ” and this packing shall be ensured not be able to arrive in the final user. (****: means the name of related management system certification which the organization obtains, such as quality or ISO9001, environment or ISO14001, food safety or HACCP, occupation health and safety or OHSMS and so on).
g) When the organization is using the mark, it can not misguide the public into thinking that CQC has carried the certification to its specific product or the service.
h) The mark can not be used in those kinds of operation which are irrelevant with the certified field and operation, and it can not be used in misguiding propaganda on all kinds of media.
i) The mark used by the organization must have the same color and the same arrangement way with the mark provided by CQC.
j) The mark can be enlarged or reduced according to the proportion, but the character of mark must be clear, the mark must be kept in integrity, also it can not be distorted.
2.2.2 The main ways of misuse/abuse mark
a) The organization doesn’t conform to the regulations and uses the mark by wrong way or misuses it in the system and business outside the certificate scope.
b) The wrong propaganda of the mark in any material, make use of the mark to misguide the public into thinking that the other management system, product or service which is out of the certificate scope get the certification; harms the prestige of CQC while propagandizing certification result.
c) Use the mark without obtaining the CQC management system certificate or the IQNet certificate.
2.2.3 The corrective measures adopted by CQC when the mark is misused / abused
a) Sends out “processing notice of misuse / abuse the mark” to the organization which misuses / abuses the mark, and orders it to correct within a limited period.
b) According to the regulation of suspension and withdrawal in the public document, suspends or withdraws the certificate.
c) If necessary, investigate the organization’s legal responsibility according to the related law.
2.2.4 The suspension of the mark use
When the certification qualification is suspended by CQC, the organization shall immediately stop using and providing the document, stationery and propaganda material or related parts of the above with CQC certification mark within the scope of certification suspension. When the certification qualification is withdrawn by CQC or is cancelled, the organization shall immediately stop using and providing the document, stationery and propaganda material or related parts of the above with CQC certification mark within the scope of certification withdrawn and cancellation.
2.2.5 The organization shall also abide by the following rules while using the mark:
a) Assure to use the mark only in the place limited in the certificate.
b) Accepts surveillance audit of CQC to the use of the mark.
c) CQC will order the organization to correct by a set time if the management system certified in its term of validity does not conform to the certification requirement, and the mark can not be used during the period of correction.
2.2.6 CQC certification mark
2.2.6.1 The CQC mark of management system certification (called CQC mark for short), as showed in chart 1, includes the mark of certificated organization and the related certification registration number of management system .

certification registration number chart 1 a) CQC mark of organization is the testifying symbol, which means the organization get the permission of CQC to conditionally use the mark in specific site to show that its management system within the scope of certificate conforms to the related management system standard or the technology standard b) The CQC mark must be used together with the related certification registration number of management system. 2.2.6.2 when the organization obtains the CQC management system certificate with the CNAS approval mark, it may use the CQC mark alone or use the combination mark of CQC mark and CNAS approval mark (see chart 2). And the CQC mark should be laid on the left of CNAS approval mark. certification registration number system certification CNAS CXXX-Y Chart 2 2.2.7 IQNet mark The organization may choose the IQNet mark, and it can only choose the following two kinds of combination way of mark: a）The combination mark of CQC and IQNet mark, as seen in chart 3.
