Newly revised Law on Science and Technology Progress take effect

The newly-revised Law on Science and Technology Progress went into effect from July 1.  A roundtable on the implementation of the Law was held in the Great Hall of the People in Beijing on the same day.  State Councilor Liu Yandong stresses that the revision and implementation of the Law serve significant meaning to implement scientific development prospective, enforce innovation strategy, and promote construction of innovative country and all around well-off society. 

The new Law provides several articles to encourage innovation.  Contractors hold rights of the patents, computer software copyright, layout design of integrated circuit and new varieties of plants made under government sponsored projects, except those relating to national security, national interest and important public interest. 

The contractors shall commercialize the IPRs, take protective measures, and submit annual report on commercialization and protection to the managing agencies.  The state may commercialize the rights or license others to commercialize free of charge if the contractors fail to commercialize within reasonable time. 中国新修订的科技进步法正式实施

国家科技计划项目承担者可依法取得相关知识产权

本报讯  新修订的《中华人民共和国科学技术进步法》已于7月1日正式实施。７月１日，贯彻实施科技进步法座谈会在北京人民大会堂举行。中共中央政治局委员、国务委员刘延东在会上强调，科技进步法的修订和实施，对于落实科学发展观，实施自主创新战略，推进创新型国家建设和全面建设小康社会，具有重大现实意义和深远历史意义。

据悉，新修订的科技进步法对鼓励科技人员技术创新作了新规定，利用财政性资金设立的科学技术基金项目或者科学技术计划项目所形成的发明专利权、计算机软件著作权、集成电路布图设计专有权和植物新品种权，除涉及国家安全、国家利益和重大社会公共利益的外，授权项目承担者依法取得。

根据新修订的科技进步法，取得知识产权的项目承担者应当依法实施知识产权，同时采取保护措施，并就实施和保护情况向项目管理机构提交年度报告；在合理期限内没有实施的，国家可以无偿实施，也可以许可他人有偿实施或者无偿实施。（向 利）
