MOA enacts new rules for plant variety

The Implementing Rules of the Regulations on the Protection of the New Varieties of Plants (Agricultural Plants) was recently enacted after revised by the conference of Ministry of Agriculture (MOA), adding provisions such as, one new variety of plant shall only be granted one variety right. 

The amendments aim to: revise provisions running counter to current laws or policies; clarify definitions and standards to ensure proper examination protocol and fair practice; streamline examination and testing procedure to upgrade service; fill in necessary regulative blanks. The Rules will be in force on January 1, 2008.

农业部修订《植物新品种保护条例实施细则》

本报讯　经农业部常务会议修订通过的《中华人民共和国植物新品种保护条例实施细则（农业部分）》（以下简称《细则》）近日公布。细则规定，一个植物新品种只能被授予一项品种权。对授予品种权的条件进行了详细的补充说明。

据介绍，此次修订的内容主要包括：一是修改违背现行法规政策的内容，理顺制度关系；二是明确概念和标准，规范审查，保证公平公正；三是梳理审查测试程序，提高效率、强化服务；四是补充完善，填补制度空白。《细则》将于２００８年１月１日起开始实施。　（尹训宁）
