According to the provisions of Anti-dumping Regulations of the People' s Republic of China, Customs Tariff Commission of the State Council has decided to levy anti-dumping duty on the dimethyl cyclosiloxane imported from and originally produced in Japan, the US, UK and Germany as of January 16, 2006. The anti-dumping duty rate of 14% applied to Japan GE Toshiba Silicones Co., Ltd. (Announcement No. 3 (2006) of General Administration of Customs and Announcement No. 123 (2005) of the Ministry of Commerce). According to the confirmation made by the Ministry of Commerce recently, General Administration of Customs makes a decision that Momentive Performance Materials Japan LLC shall succeed the anti-dumping duty rate in the case of anti-dumping of Dimethyl cyclosiloxane applicable to Japan GE Toshiba Silicones Co., Ltd. Matters in relation to the enforcement of the anti-dumping measures are hereby announced as follows:
1. The Customs will levy anti-dumping duty on the Dimethyl cyclosiloxane declared to be imported from Momentive Performance Materials Japan LLC as the original producer at the anti-dumping duty rate of 6.4% and levy anti-dumping duty on the Dimethyl cyclosiloxane declared to be imported from Japan GE Toshiba Silicones Co., Ltd. as the original producer at the anti-dumping duty rate of 22% applicable to "other Japanese corporations" as of August 19, 2008.
2. Provisions of relevant announcements of General Administration of Customs shall still be applicable to other issues related to the imposition of anti-dumping duty on the Dimethyl cyclosiloxane imported from and originally produced in Japan, the US, UK and Germany.
