Announcement No. 89, 2008 of the Ministry of Commerce on Initiating Anti-dumping

On September 25, 2008, the Ministry of Commerce of the People's Republic of China received the formal application for anti-dumping investigation submitted by, on behalf of the domestic Polyamide-6,6 industry, Pingdingshan Shenma Engineering Plastics Co., Ltd., where the applicant requested an anti-dumping investigation into the imported Polyamide-6,6 originating in the United States, Italy, Britain, France and Taiwan.
According to the provisions of theRegulations of the People's Republic of China on Anti- dumping,the Ministry of Commerce examined the related issues, namely,the qualification of the applicant, the information about the products under application for investigation, the information about the like products of China mainland, the impact of the products under application for investigation upon the industry of China mainland, as well as the related situation of the country and region under application for investigation and so on. At the same time, the Ministry of Commerce examined the evidences described in the application on dumping, injury and their cause and effect relationships between. The preliminary evidences provided by the applicant indicated that since the annual output of the applicant-- Pingdingshan Shenma Engineering Plastics Co., Ltd. for Polyamide-6,6 was beyond 50% of the total output of China mainland for the like products in 2005, 2006, 2007 and January to March of 2008, it was in line with the Article 11, 13 and 17 of the Regulations of the People's Republic of China on Anti- dumping for the domestic industry to submit applications for anti-dumping investigation. At the same time, the application included issues and evidences specified in the Article 14 and 15 of theRegulations of the People's Republic of China on Anti- dumping for initiating anti-dumping investigation.
Based on the above results of examination and according to the provision of the Article 16 of the Regulations of the People's Republic of China on Anti- dumping, the Ministry of Commerce decides to initiate anti-dumping investigation into the imported Polyamide-6,6 originating in the United States, Italy, Britain, France and Taiwan. The relevant matters are hereby promulgated as follows:

Based on the above results of examination and according to the provision of the Article 16 of the Regulations of the People's Republic of China on Anti- dumping, the Ministry of Commerce decides to initiate anti-dumping investigation into the imported Polyamide-6,6 originating in the United States, Italy, Britain, France and Taiwan. The relevant matters are hereby promulgated as follows:
