III. Acceptance and time limit for the preliminary examination
(I) Acceptance for the preliminary examination
1. If Animals and animal products applied are prohibited from entry; if there is any related animal disease in countries where the export and transit take place; if it is in accordance with regulations of Chinese law on quarantine of animals and provisions of the related administration; If it is in accordance with bilateral quarantine agreement (including quarantine agreement, protocol, memo etc.) signed by and between China and exporting countries.
2. If the needed material can be provided completely and kept available in deferent animals, animal products or items for special examination and approval applied to enter.
(II) Time limit for the preliminary examination
Within 5 working days since the date of acceptance, a decision shall be made on whether submitting to the general administration (the time for production, processing, storage, isolated court assessment is not included and shall be informed by the acceptance authority).
IV. Basis and scope for the quarantine permit
Article 10 of Law on the Quarantine of Animals and Plants Brought Into or Taken Out of the Chinese Territory: "In case animals, their products , plant seeds, seedlings or other propagation materials need to be imported, an application must be submitted in advance and go through the formalities for examination and approval of quarantine inspection"; article 5: In case the scientific research specially needs the introduction of animal and plant pathogens (including bacteria, viruses, etc.), insect pests and other types of objects prohibited from entering the country, an application must be firstly submitted to the State animal and plant quarantine authority for approval. Article 23: "Whoever requests a transit of animals through the Chinese territory must obtain in advance and through consultation the consent of China's State animal and plant quarantine department and the transit must be conducted through the designated port and route". The related regulations also can be found clearly in the Implementing Rules for Law on the Quarantine of Animals and Plants Brought Into or Taken Out of the Chinese Territory. Article 35 of Regulation on the Administration of the Security of Genetically Modified Agricultural Organisms: "In case any form of genetically modified agricultural organisms needs to be transited through the territory of the people's Republic of China, the owner shall obtain in advance the approval of China's State entry-exit quarantine department in accordance with related regulations of the PRC law and provisions of administration". These articles are the basis of the quarantine examination and approval.
The State Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China (SAQSIQ) announced List of Examination and approval of Imported Animals and Plants Quarantine to specify the scope of examination and approval of animals quarantine as follows:
(I) Examination and approval for the quarantine of animals
1. Live animals: animals (referring to farming/wild animals such as livestock, poultry, beasts, snakes, turtles, shrimp, crab, shellfish, silkworms, bees, etc.), embryos, semen, oosperm, hatching eggs and other animal genetic materials;
2. Animal products as food: raw meat and its products (including organs), fresh eggs and fresh milk.
3. Non-edible animal products: hides (not including wet (dry) blue, tanned fur), hairs (not including wash-up down, wash-up hair, carbonized hair, hair tops), bones/ hoofs/ angles and their products, gelatin, cocoons, feed and additives from animals, organic fertilizers containing animal ingredients such as fish meal, meat meal, bone meal, meat and bone meal, fat, blood meal, blood, etc.
In addition, the Ministry of Agriculture and the General Administration of Quality Supervision have jointly issued a document (see nongmufa No. 21 [2000] and No. 144 [2001]) to specify animal feed products with a necessity of quarantine examination and approval in details as follows: Animals feed products refer to the feed obtained after industrialization process with products derived or made from animals, including meat and bone meal, bone meal, meat meal, blood meal, plasma meal, animal offal, animal fats, dried plasma and other blood products, protein dehydration, hoof meal, horn meal, chicken giblets, feather meal, oil residue, fish meal, dicalcium phosphate, bone glue, as well as various types of feed made of the above raw materials.
(II) Special examination and approval
Animal pathogens (including bacteria, viruses, etc.), insect pests and other pests, related animals, animal products and other quarantine objects (animal vaccine, serum, diagnosis fluid, animal waste, etc.) in countries or regions with animal loimia, animal carcasses.
In addition, as specified in the List of Animals, Animal Products and Others Quarantine Objects Prohibited from Entering through Carrying and by Post (announced and implemented by the Ministry of Agriculture on June 11, 1992), cells, serum, animal waste as well as items possibly contaminated by pathogens included in the importation shall be taken into the special examination and approval. In short, for any quarantine object prohibited from entry, the said special examination and approval must be obtained in advance.
(III) Examination and approval for quarantine of imported animals
According to Regulation on the Administration of the Security of Genetically Modified Agricultural Organisms, for any transit of transgenic animals, animal products and microorganism, the examination and approval from China's entry-exit inspection and quarantine authorities is also a must,
The above-mentioned scope of examination and approval is not unchangeable, the General Administration of Quality Supervision may, in a timely manner, draft, adjust and release the list of animals and their products subject to quarantine examination and approval in accordance with relevant laws and regulations, as well as the list of objects prohibited from entry issued by relevant departments of the State Council.
(IV) Abolition of requirements for quarantine permit of low-risk products
Announcement No. 43 [2003] and Announcement No. 111 [2004] were released successively by SAQSIQ to no longer require quarantine permit for animal products such as wet (dry) blue, tanned fur, wash-up down, wash-up hair, carbonized hair, hair tops, shell as material for crafts, aquatic products , bee products, egg products (excluding fresh eggs) , dairy products (except milk), cooked meat products (for example, sausage, ham, canned meat, animal fats and oils refined under high temperature), lactic acid bacteria, yeast.
V. Responsible authorities for quarantine examination and approval
The SAQSIQ is responsible for unified management of the nationwide quarantine examinations and approvals for entry animals and plants. The SAQSIQ or other authorized bodies for examination and approval (hereinafter referred to as the examination and approval authorities) take charge of the issue of the PRC Quarantine Permit for Entry Animals and Plants and the PRC Circular on Not Approving the Application for Quarantine Permit for Entry Animals and Plants. All inspection and quarantine bureaus directly under (hereinafter referred to as the preliminary examination authorities) are responsible for the preliminary examination of entry animals and plants in their own jurisdictional areas.
VI. Criteria for the quarantine examination and approval for animals and their products
According to the Implementing Rules for Law on the Quarantine of Animals and Plants, the quarantine examination and approval procedure shall be considered only when it meets the following criteria:
(I) No prevalent epidemic animal or plant diseases in exporting countries or regions;
(II) In accordance with the provisions of the relevant Chinese laws, regulations and rules on animal and plant quarantine;
(III) In compliance with relevant bilateral quarantine agreements (including quarantine agreements, aide-memoires, etc.) signed between and by China and the exporting countries or regions.
