The goods or materials are considered as originated from another member state or region on the condition that they are originated from or used to produce another goods and formed as a part of the goods in this member state or region under preferential trade agreement.
Tiny handling of processing, package and display for the convenience of loading, transportation, storage and sales, doesn't influence the confirmation of the origin of goods
Packing materials and containers to protect the goods during the transportation, doesn't influence the confirmation of origin of goods
The origin of materials or articles that doesn't constitute the part of the goods during production process, doesn't influence the confirmation of origin of goods
When making a declaration during the import of goods, the consignee and consignor or their agent, should fill the Customs Declaration for Import Goods of Customs of the people's republic of China according to the declaration regulation of Customs. The importer shall submit the following documents when the goods are applicable to conventional tariff or preferential tariff
(1) The valid original certificate of origin of the goods or origin declaration files according to related regulation of preferential trade agreement
(2) Commercial documents such as original commercial invoice, transport documents etc.
The certificate of origin submitted by the consignee or his agent should meet the following requirements
(1) Meet the provision of document format, content, signature and submission deadline according to the privileged trade agreement
(2)In correspondence with the content of commercial invoice and declaration form,
The consignee and his agent should make supplementary declaration to confirm whether the import goods are qualified to member state or region under preferential trade agreement during the declaration of importing goods which come from such area, and the certificate or declaration of origin submitted according to relevant regulation.
Import goods and package under preferential trade agreement signed with place of origin mark, the origin mark should be in accordance with the origin of goods according to this regulation
The import goods is not applicable to conventional tariff or preferential tariff on the following conditions
(1) The consignee or his agent neither submit certificate or declaration of origin that conform to the regulation when making a declaration, nor make supplementary declaration on whether the import goods can match origin qualification.
(2) The consignee or his agent doesn't provide commercial invoice, transport document etc. or submit qualified files required by this regulation
(3)The origin of goods doesn't conform to the declaration or can't be determined which is the real place of origin after checking or verification,
(4) Other circumstance that doesn't conform to this regulation or relevant preferential trade agreement.
This regulation shall take effect on Mar.1, 2009
